Types of Lawyers in the UAE — Advocates, Consultants and Every Practice Area Explained

Search "lawyer in Dubai" and you get thousands of names. What the results never explain is that UAE law does not treat all lawyers the same: some can stand up in court for you, some can only advise, and each practice area has its own procedures, deadlines and even its own court. Hiring the wrong type wastes money — and sometimes a limitation period.

Direct answer. Two. The UAE licenses two core categories of lawyer: advocates (muhami), who are entered on an official roll and may represent clients before the courts, and legal consultants (mustashar qanuni), who advise, draft and negotiate but do not plead before onshore courts. The profession is regulated at federal level under Federal Decree-Law No. 34 of 2022 on the Regulation of the Legal Profession, administered by the Ministry of Justice (www.moj.gov.ae), with emirate-level rolls in Dubai. Advocate vs legal consultant: the one distinction that matters

The single most important thing to check before hiring is whether your lawyer is a licensed advocate or a legal consultant. The two roles overlap in advice work but differ sharply in court.

• Advocate (*muhami*). Entered on the roll of practising advocates. Can file cases, attend hearings, plead before the Court of First Instance, Court of Appeal and Court of Cassation, and sign court pleadings. Rights of audience before the higher courts are tiered by seniority — the exact experience thresholds are set by the Ministry of Justice and can change, so confirm the current rules with the Ministry of Justice or a licensed UAE lawyer.
• Legal consultant (*mustashar qanuni*). Licensed to give legal advice, draft and review contracts, structure transactions and represent clients in negotiations and many arbitration settings — but not to plead before the onshore courts. Most foreign-qualified lawyers in the UAE practise as legal consultants.

Two practical consequences follow:

• If your matter is heading to litigation in the Dubai Courts or any onshore court, you will need a licensed advocate — usually a UAE national advocate for full litigation rights — even if a foreign consultant manages the strategy.
• If your matter is advisory (a contract, a company setup, a settlement), a legal consultant may be exactly the right hire, often with deep common-law or home-jurisdiction expertise.

Note the exception: the DIFC and ADGM financial free zones run their own common-law courts with separate practitioner registration, so a lawyer's onshore status does not automatically carry over there.

What is a lawyer called in Arabic? Muhami, mustashar and other terms you will see

The everyday Arabic word for lawyer is muhami — the licensed advocate who pleads in court. Knowing a handful of transliterated terms helps you read licences, court documents and office signage correctly:

• *Muhami* — advocate/lawyer; the person with rights of audience before the courts.
• *Mustashar qanuni* — legal consultant; advises and drafts but does not plead onshore.

If a firm's letterhead says "legal consultants" rather than "advocates and legal consultants", that is a signal about its court capability — not a red flag, just a scope marker.

Labour and employment lawyers

Hire a labour lawyer when a workplace dispute involves real money or your visa status — unpaid salary, denied gratuity, arbitrary dismissal or a non-compete threat. Private-sector employment is governed by Federal Decree-Law No. 33 of 2021 (full text), and most claims must pass through MOHRE conciliation before reaching the labour courts. A family lawyer handles divorce, custody, maintenance (nafaqa), marriage registration and inheritance — matters where the applicable law can depend on your nationality and religion, so specialist advice pays for itself early. If you are arrested, questioned or named in a criminal complaint in the UAE, a criminal defence advocate — not a consultant — is the type you need, because criminal representation happens in court and before the Public Prosecution. How to check a lawyer is licensed in the UAE

Never rely on a website title — verify the licence itself before signing a wakala. Three checks take minutes:

• Federal roll. The Ministry of Justice regulates the profession and maintains the advocates roll under Federal Decree-Law No. 34 of 2022 — start at the Ministry of Justice portal. In Dubai, advocates and consultants are also licensed at emirate level, so ask which roll the lawyer is on.
• Scope. Ask directly: "Are you a licensed advocate with rights of audience, or a legal consultant?" A reputable practitioner answers in one sentence.
• Court tier. For appeals or cassation, confirm the advocate is qualified for that tier — the seniority requirements are set by the Ministry of Justice and can change, so confirm the current position with the Ministry or the lawyer's licensing authority.
