Bail
الكفالة الجزائية
Bail is the conditional release of an accused person during a criminal investigation or trial, instead of detention. In the UAE the Public Prosecution or the court may grant it, typically against a guarantee: a cash deposit, a personal guarantor, or surrender of the accused's passport — sometimes a combination. Bail does not end the case; the accused must attend every summons, and breaching conditions can mean re-arrest and forfeiture of the guarantee. The decision weighs the seriousness of the charge, flight risk, and the state of the investigation, and refusals can be renewed as detention is periodically reviewed. It matters because the difference between defending a case from home and from a cell is enormous — practically and professionally. You meet it after arrest or prosecution questioning, when your lawyer applies for release; the passport-surrender form of bail is especially significant for expatriates, since it suspends international travel until the case ends.
