    Chapter One Definitions: Definitions

    Article (1) For the purposes of implementing the provisions of this Regulation, the following terms and expressions shall have the meanings assigned to each of them, unless the context requires otherwise: State : The United Arab Emirates.     Chapter Two Licensing: Licensing

    Article 2

    Article (2) It is not permitted to practice Land Transport activity except after obtaining a license from the Authority.

    Article 3

    Article (3) Types of Licenses The Authority shall issue Licenses to practice Land Transport activities in accordance with the following conditions and procedures: 1. Licensing for Sole Proprietorships: It is permitted to practice Land Transport activities in accordance with the following conditions: First: Establishments that own no more than ten (10) Means of Transport: a. The owner shall be a citizen of the United Arab Emirates. b. A copy of the commercial license shall be submitted (after the competent employee has examined the original). c.     Article 4

    Article (4) Opening Branches Establishments and companies may open a Branch or Branches to practice Land Transport activity, provided that prior License is obtained from the Authority for the Branch, in accordance with the licensed activity and within the licensed category, and in accordance with the provisions of the Companies Law and based on the Licenses issued by the Competent Authorities. The Branch shall also be subject to the same required conditions and procedures for licensing as stipulated in this Regulation.

    Article 5

    Article (5) Procedures for Obtaining a Permanent License Upon submission of a License application, the Authority shall undertake the following procedures: 1. Review the submitted application to ensure fulfillment of the conditions. 2. Decide on the application and notify the applicant in writing of the rejection or approval within ten working days. 3. Inspect the applicant's offices. 4. In the event of rejecting the application, the rejection shall be reasoned.

    Article 6

    Article (6) Type, Duration, and Renewal of the License The Authority shall issue two types of Licenses, which are: First: Initial Approval: (valid for a period of three months and may be renewed for a similar period only if there are reasons and justifications for doing so). It shall be issued pending the completion of registration procedures and obtaining Licenses from other authorities for establishment purposes, in accordance with the following: 1. A letter from the local authority that issues commercial/professional licenses in the emirate where the activity is to be practiced. 2. The application shall be submitted on the Form prepared for this purpose and attached to this Regulation. 3.…

    Article 7

    Article (7) Insurance Policy The Licensee shall provide an Insurance Policy issued by one of the local companies for all means of transport intended to be licensed, which shall cover the following: 1. The means of transport or equipment. 2. The driver and the assistant. 3. The third party. 4. Civil compensations. 5. Goods and Passengers in accordance with the licensed category.

    Article 8

    Article (8) Cessation of Activity In the event that the Licensee wishes to cease practicing the Land Transport activity, they shall follow these steps: First: Temporary Suspension: 1. Submit a request for that purpose on the Form prepared by the Authority. 2. The period of temporary suspension shall be determined. 3. Obtain the approval of the Authority. 4. The Licensee may not practice the Land Transport business during the temporary suspension period. 5. The Operating Card for each means of transport belonging to the Licensee shall be suspended. 6. The Licensee shall surrender all original Licenses and Operating Cards to the Authority during the suspension period, to be returned thereto up…

    Article 9

    Article (9) 1. The Licensee, their heirs, guardians, or liquidators, as the case may be, may request the cancellation of the License within ninety days in any of the following cases: 2. Cessation of the activity for any reason. 3. Death of the Licensee (for individuals and sole proprietorships). 4. Liquidation of the company, whether the liquidation is by agreement of the partners, due to the expiry of its term, or by a court judgment.

    Article 10

    Article (10) De-registration of a Means of Transport Where the Licensee wishes to de-register a means of transport registered with the Authority they shall follow these steps: 1. Fill out the Form prepared for this purpose by the Authority. 2. Surrender the Operating Card for the means of transport to the Authority. 3. Payment of the prescribed Fees. In all cases, the local authorities shall not de-register any means of transport unless a certificate is obtained from the Authority stating its approval of such procedure.

    Article 11

    Article (11) The License issued by the Authority is a personal License pursuant to the provisions of the Law and may not be assigned except in accordance with the following conditions:

The assignee shall be a citizen of the United Arab Emirates if it is a sole proprietorship. 2. If the assignee is a company, the licensing conditions for companies as stated in this Regulation shall apply. 3.     Article (12) Amendment/Addition of Data or Activity Every licensed Carrier is entitled to submit a written application to the Authority to amend or add any of the data contained in the operational License, in accordance with the following: 1. The request shall be submitted on the Form approved by the Authority and attached to this Regulation. 2. The type of amendment or addition required shall be stated. 3. All data contained in the Licenses and legal documents supporting the amendment or addition, as approved by the Competent Authorities, shall be attached. 4.     Chapter Four Operating Cards and Types of Means of Transport: Operating Cards and Types of Means of Transport

    Article (14) Operating Card Data It is prohibited to operate any means of transport unless the Licensee has obtained an Operating Card from the Authority, which shall be issued in accordance with the authorized activity. The card shall contain the following information: 1. Name and logo of the Authority. 2. Name of the Licensee. 3. Address of the Licensee. 4. Vehicle plate number and License number for practicing the activity. 5. Type of licensed activity. 6. Capacity and type of vehicle. 7.     Article 15

    Article (15) Operating Cards for Passenger Buses and Goods Transport Trucks Every means of transport shall obtain an Operating Card issued by the Authority for each Bus or Truck (tractor or trailer), in accordance with the type of activity it practices: First: Passenger Transport Operating Card Categories: a.     Article 16

    Article (16) The Licensee shall retain the Operating Card within the means of transport at all times and shall present it upon request by any of the competent persons. Failure to present it shall result

    Article 17

    Article (17) In the event of loss or damage to the operating License or Operating Card, the following procedures shall be taken: First: In case of loss of the operating License or Operating Card: 1. Immediately report the loss to the Authority. 2. Provide evidence that the Licensee has filed a report with the Competent Authorities. 3. Fill out the Form prescribed by the Authority. 4. Submit an undertaking to surrender the lost License if found and to refrain from using it. 5. The Authority shall issue a new replacement License bearing a new number. 6. The Fees prescribed for issuing a replacement Operating Card, as set out in the Financial Schedule attached to this Regulation, shall be paid.…

    Article (18) Types of Means of Transport Means of transport shall be classified according to their types as follows: First: Transport of Passengers 1. International Transport: a.     Article (19) The aforementioned means of transport shall be licensed in accordance with the technical conditions approved by the Authority and the Competent Authorities, and the specifications approved by the Emirates Authority for Standardization and Metrology.

    Chapter Five Obligations and Conditions of Transport: Obligations and Conditions of Transport

    Article 20

    Article (20) Transport Documents The Licensee engaged in the activity of International Land Transport shall be required to issue the following documents: First: Passengers: 1. Issuance of individual travel tickets specifying the following: a. The Passenger's full name. b. The Passenger's address. c. ID card or passport number. d. Place of departure. e. Place of arrival. f. The Carrier's name and address. g. Date of travel and return, if applicable. The Authority shall collect a transport Fee for each Passenger using any means of Passenger transport on international journeys, in accordance with the Financial Schedule attached to this Regulation.     Article 21

    Article (21) It is prohibited to use a Means of Land Transport for a purpose other than that for which it is licensed. In the event that the Licensee wishes to use a means of transport-to-transport materials other than those for which it is licensed, the following shall be complied with: 1. Submit an application to the Authority using the Form prescribed thereby. 2. Specify the materials intended to be transported. 3. Obtain the approval of the Competent Authorities (local and federal: Ministry of Interior - Traffic Department / Local Transport Authority / Emirates Authority for Standardization and Metrology). 4. Pay the prescribed Fees.

    Article 22

    Article (22) The Authority shall establish electronic or paper records for the registration of Licensees authorized to practice the activity of Land Transport, in which the following shall be recorded: 1. Licensee data. 2. License data, including its issuance date, expiry date, and its number. 3. Details of each vehicle registered under the same License, including: a. The vehicle's specifications. b. The vehicle's tonnage capacity and number of Passengers. c. The purpose for which the vehicle is licensed. d. The vehicle's roadworthiness (as determined by an annual technical inspection).

    Article 23

    Article (23) a. The Licensee shall maintain dedicated records containing information on the following: 1. The means of transport owned or operated thereby. 2. The employees. 3. The transported materials and Goods. 4. Passenger lists for each trip separately. b. The Authority and the Competent Authorities shall have the right to review the aforementioned records upon request.

    Article 24

    Article (24) For international journeys, the Licensee shall provide the Authority with complete data for the trip, including: 1. All information relating to the means of transport and its personnel. 2. Lists of the transported materials and Goods. 3. Passenger lists. 4. Route of the trip.

    Article (25) It is prohibited for Means of Land Transport not registered in the State to enter or transit the

    Article (26) No means of transport not registered in the State may enter its territory except in accordance with the following conditions: 1. An application shall be submitted using the Form prescribed by the Authority. 2. It shall be loaded with Goods, merchandise, or Passengers. 3. The intended destination shall be specified. 4. It shall have a local agent. 5. The type and quantity of the materials carried shall be specified. 6. The prescribed Fees must be paid. 7. The requirements of the Customs Authorities and other federal and local authorities shall be complied with.

    Article 27

    Article (27) It is prohibited for a Means of Land Transport not registered in the State to conduct Land Transport operations within any emirate or between the Emirates. It is also prohibited from loading upon departure from the State to a country other than the country in which it is registered, except with a special permit in accordance with the following rules and conditions: 1. An application shall be submitted using the Form prescribed by the Authority. 2. The intended destination shall be specified. 3. Approval from the destination country shall be provided. 4.     Article (28) Drivers of Means of Land Transport shall comply with the following: 1. The means of transport used shall be licensed in accordance with the Law. 2. Carrying the original driving license. 3. Carrying the ownership document of the means of transport. 4. Carrying the Operating Card for the means of transport and affixing its sticker in a clearly visible place. 5. Carrying the Insurance Policy for the means of transport. 6.     Article (29) A Licensee may have one or more agents in the country of destination outside the State or in the (Emirate/city) for regular Passenger travel, provided that the following conditions are met in respect of such agents: 1.     Article (30) The Licensee, their agent, and the international Carrier shall comply with the following: 1.     Article (31) The Authority shall license the Guarantor in accordance with the following conditions: 1. The License applicant shall be a national. 2. The legal person shall be incorporated in accordance with the provisions of the Companies Law. 3. A bank guarantee shall be submitted to the Authority, as specified in the Financial Schedule, issued by one of the accredited banks in the State under the name of the National Transport Authority.

    Article (32) Automobile Clubs affiliated with the International Road Transport Union shall be licensed, after obtaining the approval of the Authority, to provide services for issuing Customs Transit Cards for owners of Trucks and Passenger Buses, after submitting proof of obtaining the necessary approvals from the Competent Authorities in the State in accordance with the laws, provided that: 1. A copy of the passport of the Customs Transit Card applicant shall be retained. 2. The bank guarantee submitted by the Customs Transit Card applicant shall be retained. The Authority shall have the right to examine all documents issued by such clubs.

    Article (33) The Authority shall license applicants wishing to practice the activities of Automobile Clubs in accordance with the following conditions:

    Article (34) An accredited Automobile Club in the State shall be licensed to provide special services to owners of private vehicles for the issuance of Trip-Tickets (CPD), in accordance with the form approved by the Authority, upon submission of proof of the following: 1. Its membership in and accreditation by the International Automobile Federation. 2. Its membership in and accreditation by the International Tourism Alliance. 3. Obtaining approvals from the Competent Authorities in the State in accordance with the applicable laws. 4. Obtaining the Authority's approval regarding the services provided to vehicle owners and the payment of the prescribed Fees.

    Article 35

    Article (35) An accredited Automobile Club in the State shall be licensed to issue International Driving Licenses, in accordance with the form approved by the Authority, upon submission of proof of the following: 1. Its membership in and accreditation by the International Automobile Federation. 2. Its membership in and accreditation by the International Tourism Alliance. 3. Obtaining approvals from the Competent Authorities in the State in accordance with the applicable laws. 4. Obtaining the Authority's approval regarding the services provided to vehicle owners and the payment of the prescribed Fees. 5.     Article 36

    Article (36) 1. The License issued in accordance with the provisions of this Chapter shall be valid for one year and shall be renewed within 30 days from its expiry date. In all cases, the licensing conditions shall remain satisfied throughout the validity period of the License. 2. A License may be granted to the Guarantor and the Automobile Club for a period exceeding one year upon request, provided that the prescribed Fees for the required period shall be paid in accordance with the Financial Schedule.

    Article 37

    Article (37) The Guarantor and the accredited Automobile Club accredited to issue Customs Transit Cards and Trip-Tickets (CPD), which constitute an international guarantee for the payment of Fees and taxes in the event of a customs claim arising from the failure to re-export the vehicle.

    Article 38

    Article (38) The Customs Authorities shall not permit any private vehicle registered in the State to depart from the State without obtaining a Trip-Tickets (CPD) from the accredited Automobile Club when traveling outside the State, except for vehicles of: a. Nationals departing to any of the Gulf Cooperation Council countries only. b. Nationals of the Gulf Cooperation Council countries residing in the State and departing to their countries and returning therefrom. c. Ministries and government departments departing to any of the Gulf Cooperation Council countries.

    Article 39

    Article (39) The Customs Authorities shall not permit Trucks and Passenger Buses registered in the State to depart therefrom without obtaining a Customs Transit Card from the accredited Automobile Club (Guarantor) when traveling outside the State.

    Article 40

    Article (40) The Authority shall collect an issuance Fee (in accordance with the attached Financial Schedule) for each Carnet de Passage en Douane, Customs Transit Card, and International Driving License, and the accredited Club/Guarantor shall provide the Authority with issuance lists at the end of each month.     Article (41) The penalties provided for in the Land Transport Law No. (9) of 2011 shall be applied to the

    Article (42) The Fees for Licenses, registration, certificates, and services provided pursuant to the provisions of this Regulation shall be determined by a Cabinet Resolution.

    Article (43) The employees of the Authority and the Competent Authority who are designated by a decision of the Minister of Justice in agreement with the Chairman shall have the capacity of judicial enforcement officers in establishing violations of the provisions of the Law, this Executive Regulation, and the resolutions issued in implementation thereof, each within the scope of their competence.

    Article (44) The Chairman shall authorize the Director-General to interpret the Regulation, (whenever necessary).

    Article (45) The Licensee practicing the activity of Land Transport shall be liable to compensate for damages caused to the transported Goods that are in their possession, as well as to Passengers, in accordance with the Insurance Policy.

    Article (46) Any person engaged in the field of transport shall regularize their status in accordance with the provisions of the Law and this Regulation; otherwise, they shall be subject to violations in accordance with the provisions thereof within the period specified in Article (47) of this Regulation.
