A bank guarantee (letter of guarantee) is a bank's independent undertaking to pay a beneficiary a stated amount if the bank's customer fails to meet an obligation — the backbone of UAE construction and procurement, where tender bonds, performance bonds and advance payment guarantees are standard. Its defining legal feature is autonomy: the bank pays against a compliant demand without investigating the underlying contract dispute, which is why beneficiaries prize guarantees and contractors fear unfair calls. UAE courts can block payment in narrow circumstances, and urgent applications to restrain an abusive call are a recognised, time-critical remedy. Guarantees are typically issued against cash margin or facilities, expire on stated dates, and must be extended or released as projects progress — 'extend or pay' demands near expiry are a classic pressure tactic. You meet them in construction contracts, supply tenders, customs arrangements and rental of major commercial premises.
