    Article 1

    Article (1) Definitions For the purposes of implementing the provisions of this Resolution, the following terms and expressions shall have the meanings assigned to each of them, unless the context requires otherwise: State : United Arab Emirates (UAE). Ministry : Ministry of Community Development. Minister : Minister of Community Development.

    Cabinet Resolution of 2021 Regarding the Fees for Services Provided by Ministry of Community Development 2 Non-Governmental Institutions for the Care and Rehabilitation of Persons with Disabilities (People of Determination) : Any non-governmental institution, whether for-profit or non-profit, of an educational and social rehabilitative nature, which primarily or secondarily provides special education and supportive therapeutic services within an integrated program dedicated to various categories of disabilities, and licensed pursuant to the provisions of Cabinet Resolution No. (54) of 2020 Regarding Non-Governmental Institutions for the Rehabilitation of Persons with Disabilities (People of Determination). Non-Governmental Family Counseling Center : A non-governmental family counseling center licensed pursuant to the provisions of Cabinet Resolution No. (3) of 2015 Regarding Non-Governmental Family Counseling Centers.

    Article 2

    Article (2) Service Fees In consideration of the services provided by the Ministry and listed in the schedule annexed hereto, the fees assigned thereto shall be collected.

    Article 3

    Article (3) Administrative Violations and Penalties a. Administrative fines shall be imposed on the violations specified in the schedule below, in the amounts set out opposite each of them. No. Violation Description Fine Amount (AED) First: Violations Related to Non-Governmental Institutions for the Care and Rehabilitation of Persons with Disabilities (People of Determination) 1 Failure to renew the institution’s license within thirty (30) days from its date of its expiry. 2,000

    Cabinet Resolution of 2021 Regarding the Fees for Services Provided by Ministry of Community Development 3 2 Increasing tuition fees or collecting additional fees without prior approval from the Ministry. 10,000 3 Introducing any services beyond the scope of the granted license without prior approval from the Ministry. 10,000 4 Suspending studies without prior approval from the Ministry, or failing to comply with the suspension of studies. 10,000 5 Publishing any advertisement through any media without prior approval from the Ministry. 5,000 6 Adding annex buildings adjacent to the existing building, constructing new buildings, or altering the building without prior approval from the Ministry. 5,000 7 Failure to complete the appointment of members of the administrative and technical staff as of the commencement of classes. 5,000 8 Publishing, printing, or issuing magazines or newsletters without prior approval from the Ministry. 5,000 9 Failure to obtain the Ministry's approval when appointing staff members. 5,000 10 Exceeding the maximum permitted classroom capacity. 5,000 11 Issuing certificates or documents that contradict the official records of the Ministry or the institution. 5,000 12 Relocating to another building without prior approval from the Ministry. 5,000 13 Participating in any activity without obtaining the necessary license. 10,000 14 Delegating services provided in the institution to non- specialist individuals. 5,000 15 Delay of fifteen (15) days in submitting statistical data without an acceptable excuse. 2,000

    Cabinet Resolution of 2021 Regarding the Fees for Services Provided by Ministry of Community Development 4 16 Failure to comply with the implementation of resolutions and circulars governing non-governmental institutions for the care and rehabilitation of persons with disabilities. 10,000 17 Applying new therapeutic, rehabilitative, and educational programs and methodologies without prior approval from the Ministry (1). 10,000 18 Conducting psychological tests not approved or authorized by the Ministry. 5,000 Second: Violations Related to Non-Governmental Family Counseling Center 1 Publishing advertisements without obtaining prior license, advertising following expiry thereof, or violating the conditions governing the approved advertisement. 000.1 for each month or part thereof 2 Failure to renew the license within thirty (30) days from the date of its expiry. 000.2 for each month or part thereof 3 Increasing the licensed service fees or collecting additional fees without prior approval from the Ministry. 10,000 4 Introducing any services not licensed by the Ministry. 10,000 5 Participating in family counseling center activities without obtaining prior approval from the Ministry. 10,000 6 Appointing technical staff or engaging consultants without obtaining prior approval from the Ministry. 5,000 7 Issuing certificates or documents containing information that contradicts the records approved by the Ministry. 5,000 8 Changing the location of the activity without obtaining prior approval from the Ministry. 5,000 b. The Minister may revoke the license of a non-governmental family counseling centers or a non-governmental institutions for the care and rehabilitation of persons with disabilities upon the lapse of ninety (90) days from the date of license expiry, or at the end of the academic year for non-governmental institutions for the care and rehabilitation of persons with disabilities, if students are still enrolled .

    Article 4

    Article (4) Grievance Any interested party may file a written grievance to the Ministry against the administrative penalties referred to in Article (3) of this Resolution that were imposed on them, within fifteen (15) days from the date of notification of the contested decision. Such a grievance shall be reasoned, and all supporting documents shall be attached thereto. The grievance shall be decided upon within thirty (30) days from the date of its submission in accordance with the procedures in force at the Ministry.

    Article 5

    Article (5) Final Provisions 1. The fees set out in this Resolution shall be collected using the methods determined by the Ministry of Finance. 2. For the purposes of collecting the administrative fees and fines set out in Article (3) of this Resolution, part of a day shall be deemed a full day, and part of a month shall be deemed a full month. 3. Non-profit, non-governmental institutions for the care and rehabilitation of persons with disabilities shall be exempt from the fees prescribed under this Resolution.

    Article 6

    Article (6) Amendment of Administrative Fees and Fines The Cabinet shall be competent to make any amendments to the administrative fees and fines set out in this Resolution, whether by addition, deletion or modification.

    Article 7

    Article (7) Executive Resolutions The Minister shall issue the resolutions necessary for the implementation of the provisions of this Resolution.

    Article 8

    Article (8) Repeals Cabinet Resolution No. (11) of 2014 Regarding the Fees for Services Provided by the Ministry of Community Development is hereby repealed, as well as any provision that contradicts or conflicts with the provisions of this Resolution.

    Article 9

    Article (9) Publication and Enforcement This Resolution shall be published in the Official Gazette and shall enter into force from the day following the date of its publication.
