العلامة التجارية
A trademark is any sign — a word, logo, three-dimensional mark, colour combination, sound, or even smell — that distinguishes the goods or services of one enterprise from those of others. In the UAE, trademarks are governed by Federal Decree-Law No. 36 of 2021 on Trademarks. Registration is made with the Ministry of Economy and confers an exclusive right for ten years, renewable indefinitely for successive ten-year periods. The UAE is a party to the Madrid Protocol, allowing international registration with UAE effect. Infringement can be pursued through civil action for damages and injunction, through criminal action (counterfeiting attracts imprisonment and fines), and through customs recordal that empowers customs to intercept infringing goods at the border. Well-known marks receive broader protection even without registration.
