Article (5) 1. A penalty of imprisonment for a period of not less than one (1) year and a fine of not less than AED 250,000 (two hundred and fifty thousand dirhams) and not exceeding AED 1,000,000 (one million dirhams), or either of these two penalties, shall be imposed on any person who commits any of the acts stipulated in Clauses (2), (3), and (5) of Article (4) of this Decree by Law through any means of expression, in any other form, or through any medium. 2. A penalty of imprisonment for a period of not less than two (2) years and a fine of not less than AED 500,000 (five hundred thousand dirhams) and not exceeding AED 2,000,000 (two million dirhams) shall be imposed on any person who commits any of the acts stipulated in Clauses (1) and (4) of Article (4) of this Decree by Law through any means of expression, in any other form, or through any medium. Article (11) A penalty of imprisonment for a period of not less than two (2) years and a fine of not less than AED 500,000 (five hundred thousand dirhams) and not exceeding AED 2,000,000 (two million dirhams), or either of these two penalties, shall be imposed on any person who produces, manufactures, promotes, sells, offers for sale or circulation any products, goods, printed materials, recordings, films, tapes, discs, computer programs, smart applications, electronic data, industrial materials, or any other items containing any means of expression that would result in contempt of religions, discrimination, or incitement of hate speech. Article (12) 1. A penalty of imprisonment for a period of not less than one (1) year and a fine of not less than AED 50,000 (fifty thousand dirhams) and not exceeding AED 200,000 (two hundred thousand dirhams), or either of these two penalties, shall be imposed on any person who possesses or holds documents, printed materials, recordings, films, tapes, discs, computer programs, smart applications, electronic data, industrial materials, or any other items containing any means of expression intended for distribution or disclosure to others, with the intent to promote contempt of religions, discrimination, or incite hate speech. 2. The same penalty shall apply to any person who possesses or holds any means of printing, recording, storing, broadcasting, viewing, publishing, transmitting, or promoting intended for use in the commission of any of the crimes stipulated in this Decree by Law while being aware thereof. Article (13) A penalty of imprisonment for a period of not less than five (5) years and a fine of not less than two hundred thousand (200,000) dirhams and not exceeding five hundred thousand (500,000) dirhams, or either of these two penalties, shall be imposed upon any person who violates any provision of Article (7) of this Law. In all cases, the materials constituting the subject matter of the violation shall be confiscated, and the closure of the establishment for a period of not less than one month may be ordered. Article (14) Criminal Penalties Without prejudice to any more severe penalty prescribed by any other law, a penalty of temporary imprisonment and a fine of not less than AED 100,000 (one hundred thousand dirhams) and not exceeding AED 500,000 (five hundred thousand dirhams), or either of these two penalties, shall be imposed on any person who falsifies the data of goods imported into the State or exported therefrom, or who provides misleading information with the intent to commit fraud in relation to a Certificate of Origin or an Indication of Origin. Article (14) A penalty of temporary imprisonment and a fine of not less than AED 20,000 (twenty thousand dirhams) and not exceeding AED 100,000 (one hundred thousand dirhams) shall be imposed on any person who: 1. Uses the Federal DNA Fingerprinting Database to establish parentage or kinship without a judicial order. 2. Uses the Federal DNA Fingerprinting Database for purposes other than those specified in this Decree by Law. 3. Discloses, circulates, publishes, or reveals the data contained in the Federal DNA Fingerprinting Database in contravention of the provisions stipulated in this Decree by Law. 4. In bad faith, alters or deletes a DNA record, issues inaccurate data relating thereto, or conceals a match thereof. 5. Intentionally destroys biological samples or traces in contravention of the provisions stipulated in this Decree by Law. 6. Uses biological samples collected pursuant to the provisions of this Decree by Law for purposes other than those prescribed therein. Disturbing Crime or Crime Involving a Breach of Honor or Trust

Article (15) A penalty of imprisonment and a fine of not less than five thousand (5,000) dirhams, or either of these two penalties, shall be imposed upon any person who, directly or indirectly, discloses any confidential information relating to the implementation of the Convention which the State has received from a State Party to the Convention or from the Organization, and which such person has become aware of by virtue of their employment. A legal person shall be punished by a fine of not less than fifty thousand (50,000) dirhams where its board members, employees, or legally authorized representatives commit any of the aforementioned acts. Article (16) Without prejudice to the penalties prescribed for the offences stipulated in this Decree by Law, a penalty of imprisonment and a fine not exceeding AED 100,000 (one hundred thousand dirhams), or either of these two penalties, shall be imposed on any person who violates any other provision of this Decree by Law or the resolutions regulating the same. Article (17) The representative, manager, or agent of a legal person shall be punished with the same penalties prescribed for the committed crime where any of the crimes stipulated in this Decree by Law is committed by one of its employees in its name and for its benefit, provided that their knowledge thereof is established. Article (17) Penalties 1. A penalty of imprisonment and a fine not exceeding AED 50,000 (fifty thousand dirhams), or either of these two penalties, shall be imposed on any person who deliberately provides false information or deliberately refrains from providing the information referred to in this Decree by Law or its Executive Regulation in order to obtain social support, increase the amount of social support, or continue receiving social support without legal entitlement. 2. Article (18) 1. Violates any provision of Articles (9) and (11) of this Decree by Law. b. Provides false or misleading information, or documents containing forged or incorrect data, with the intent of obtaining a permit. c. Forges or alters a permit. 2. The acts stipulated in Clause (1) of this Article shall constitute crimes prejudicial to State security. 3. The penalty shall be doubled in the event of recidivism. 4. Upon conviction, the Court shall order the confiscation of the goods that are the subject matter of the crime. 5. Article (18) The penalty prescribed for the offences referred to in Article (17) of this Decree by Law shall be aggravated to imprisonment and a fine of not less than AED 100,000 (one hundred thousand dirhams) and not exceeding AED 2,000,000 (two million dirhams), or either of these two penalties, in the following cases: 1. Where the act of fraud, deception, or counterfeiting in respect of goods, or the attempt thereof, is associated with the use of forged or tampered weights, measures, standards, seals, labels, or testing devices, or with the use of methods and means that render the weighing, measuring, testing, or inspection of the product inaccurate. 2. Where the adulterated, spoiled, or counterfeit goods, or the materials used in their adulteration, are harmful to human or animal health and safety. 3. Where the adulterated, spoiled, or counterfeit goods are medicinal products, agricultural produce, or organic food products. Disturbing Crime or Crime Involving a Breach of Honor or Trust

Article (20) 1. A fine of not less than AED 200,000 (two hundred thousand dirhams) and not exceeding AED 2,000,000 (two million dirhams) shall be imposed on any legal person whose representative, manager, or agent acting on its behalf or for its account commits any of the crimes stipulated in this Decree by Law. 2. Upon conviction of the legal person, the Court may order its dissolution, its permanent or temporary closure, or the closure of one of its branches. Does not require rehabilitation pursuant to Article (15) of the aforementioned Federal Law No. (5) of 2022.

Article (20) Punishment of the Person Responsible for the Actual Management of a Legal Person 1. The person responsible for the actual management of the offending legal person shall be punished with the same penalty prescribed under Articles (17) and (18) of this Decree by Law where it is established that they were aware of the offence and failed to take the necessary measures in respect thereof, or where their gross breach of the duties imposed upon them by such management contributed to its commission. 2. The person responsible for the actual management of the legal person shall be jointly liable with the legal person for the payment of any fines imposed thereon where the offence was committed by one of the employees of the legal person in its name or for its benefit. Article (21) 1. Where the manager of a private health facility, the person responsible for its operation or management, or any of its employees violates the provisions of this Law, its Executive Regulation, or the Resolutions issued in implementation thereof, the Health Authority shall impose one of the following disciplinary sanctions: a. A warning. b. A fine of not less than AED 1,000 (one thousand dirhams) and not exceeding AED 500,000 (five hundred thousand dirhams). c. Suspension from work for a period not exceeding six (6) months. d. Permanent prohibition from practicing the profession. 2. Where a private health facility violates the provisions of this Law, its Executive Regulation, or the Resolutions issued in implementation thereof, the Health Authority shall impose one of the following disciplinary sanctions: a. A warning. b. A fine of not less than AED 1,000 (one thousand dirhams) and not exceeding AED 1,000,000 (one million dirhams). c. Full or partial temporary closure of the facility for a period not exceeding six (6) months. d. Full or partial permanent closure of the facility. 3. None of the sanctions provided for in this Article may be imposed unless the statements of the violator, or their legally Does not require rehabilitation pursuant to Article (15) of the aforementioned Federal Law No. (5) of 2022.

Cabinet Resolution of 2025 Regarding Misdemeanors and Felonies Deemed Disturbing or Involving a Breach of Trust or Honor in Relation to Judicial Rehabilitation 9 authorized representative, have been heard and their defense has been examined. If they fail to appear, or appear but submit no defense, the sanction may be imposed on the basis of the documents contained in the file. 4. The imposition of the disciplinary sanctions stipulated in this Article shall not prejudice any criminal or civil liability arising from the same act constituting the violation.

Article (21) Penalty for the Crime of Domestic Violence A penalty of imprisonment and a fine not exceeding AED 50,000 (fifty thousand dirhams), or either of these two penalties, shall be imposed on any person who commits the crime of Domestic Violence stipulated in Article (4) of this Decree by Law. Where the victim is one of the offender’s parents or ascendants, a person over sixty (60) Gregorian years of age, a pregnant woman, a child, a Person with Disability, or a person lacking legal capacity, or where the offender commits the crime of Domestic Violence within one year from the commission of the previous act, such circumstance shall constitute an aggravating circumstance. In addition to the penalties prescribed in this Article, the competent court shall require the perpetrator of the Domestic Violence offence to attend anti-violence rehabilitation programs at specialized centers. Article (23) Penalty for Violating a Protection Order A penalty of imprisonment and a fine of not less than AED 5,000 (five thousand dirhams) and not exceeding AED 10,000 (ten thousand dirhams), or either of these two penalties, shall be imposed on any person who violates a Protection Order issued pursuant to the provisions of this Decree by Law. The penalty shall be imprisonment for a period of not less than six (6) months and a fine of not less than AED 10,000 (ten thousand dirhams) and not exceeding AED 100,000 (one hundred thousand dirhams), or either of these two penalties, where the violation of the Protection Order is accompanied by the use of violence or coercion against any person covered by the provisions of this Decree by Law. Article (23) Penalties Without prejudice to any more severe penalty prescribed by any other law, a penalty of imprisonment for a period of not less than six (6) months and a fine of not less than AED 100,000 (one hundred thousand dirhams) and not exceeding AED 1,000,000 (one million dirhams), or either of these two penalties, shall be imposed on any person who: 1. Establishes or operates a private health facility without obtaining a license therefor from the Health Authority. 2. Operates a private health facility in respect of which a judicial judgment or decision has been issued ordering its permanent closure, or its temporary closure before the reasons for such closure cease to exist and a decision for its reopening is issued. 3. Submits documents or makes incorrect statements, or employs unlawful means, for the purpose of obtaining a license for the establishment, operation, or management of a private health facility. 4. Employs a physician, nurse, or any other person belonging to another health profession without being licensed by the Health Authority. 5. Closes a private health facility without the approval of the competent Health Authority. The Court may, in addition to the original penalty, order the closure of the facility or the revocation of the license, as the case may be. Article (25) 1. A penalty of imprisonment and a fine of not less than AED 200,000 (two hundred thousand dirhams) and not exceeding AED 2,000,000 (two million dirhams), or either of these two penalties, shall be imposed on: a. Any person who practices the profession without obtaining a license and who does not satisfy the conditions entitling them to obtain such license. b. Any person who submits incorrect documents or information, or resorts to unlawful means, resulting in the grant of a license thereto without lawful entitlement. c. Any person not licensed to practice the profession who uses publications, signboards, notices, or any other means of publication that may lead the public to believe that they are entitled to practice the profession. 2. A conviction for the offence stipulated in Clause (1)(b) of this Article shall entail the revocation of the license issued and the removal of the convicted person's name from the Register of Physicians as of the date of issuance of the final judgment. 3. In all cases, the Health Authority may administratively close the health facility where the violator practices therein alone. Disturbing Crime or Crime Involving a Breach of Honor or Trust

Article (25) A penalty of imprisonment for a period not exceeding one (1) year and a fine of not less than AED 10,000 (ten thousand dirhams) and not exceeding AED 50,000 (fifty thousand dirhams), or either of these two penalties, shall be imposed on any person who: 1. Becomes aware of the commission of any of the crimes referred to in the preceding two Articles of this Law and fails to immediately notify the Ministry, the competent authority, or the nearest police station thereof. 2. Discloses the identity of a person who reported a crime committed against a Senior Emirati who is unable to care for themselves without the consent of the reporter, or discloses the identity of the parties involved in the facts relating to such crimes. The same penalty shall be imposed on any person who intentionally provides incorrect information resulting in the failure to fully discharge the amounts due to the Authority. In all cases, the Court shall order the repayment of amounts disbursed without legal entitlement or the recovery of amounts due to the Authority. Any private-sector employer subject to the provisions of this Decree by Law shall be punished by a fine not exceeding AED 50,000 (fifty thousand dirhams) for each employee whom the employer fails to register with the Authority. The same penalty shall be imposed on every employer who requires employees to bear any portion of the contributions or any amounts not provided for under this Decree by Law. The Court shall, of its own motion, order the offending employer to pay to the employees the value of the contributions unlawfully charged thereto. The fine shall be multiplied according to the number of employees in respect of whom the violation was committed. 3. All additional amounts, fines, and sums awarded for violations of the provisions of this Decree by Law shall accrue to the Authority. Defacing, obliterating, or altering the particulars of a number plate and using it for the purpose for which it was issued. 3. Permitting another person to use a number plate while knowing that it has been obliterated, defaced, or altered. 4. Transferring a number plate from one vehicle to another without the approval of the Licensing Authority. 5. Installing a number plate, or assisting or facilitating its installation, in contravention of the provisions of this Decree by Law and its Executive Regulation. Article (35) Penalty for Driving a Vehicle Under the Influence of Psychotropic Substances 1. A penalty of imprisonment and a fine of not less than AED 20,000 (twenty thousand dirhams) and not exceeding AED 100,000 (one hundred thousand dirhams), or either of these two penalties, shall be imposed on any person who drives or attempts to drive a vehicle on the road while under the influence of alcoholic beverages. The Court shall suspend the driving license for a period of not less than three (3) months upon the first offence, six (6) months upon the second offence, and shall revoke it upon the third offence. 2. A penalty of imprisonment and a fine of not less than AED 30,000 (thirty thousand dirhams) and not exceeding AED 200,000 (two hundred thousand dirhams), or either of these two penalties, shall be imposed on any person who drives or attempts to drive a vehicle on the road while under the influence of narcotic drugs, psychotropic substances, or substances deemed of a similar nature. The Court shall suspend the driving license for a period of not less than six (6) months upon the first offence, one (1) year upon the second offence, and shall revoke it upon the third offence. Article (37) Penalty for Driving Without a Driving License or with a Non- Recognized License In the event of recidivism, a penalty of imprisonment for a period of not less than three (3) months and a fine of not less than AED 5,000 (five thousand dirhams) and not exceeding AED 50,000 (fifty thousand dirhams), or either of these two penalties, shall be imposed. 2. A penalty of imprisonment for a period not exceeding three (3) months and a fine of not less than AED 5,000 (five thousand dirhams) and not exceeding AED 50,000 (fifty thousand dirhams), or either of these two penalties, shall be imposed on any person who drives a vehicle on the road without a driving license, or with a license that does not authorize them to drive that category of vehicle. In the event of recidivism, a penalty of imprisonment for a period of not less than three (3) months and a fine of not less than AED 20,000 (twenty thousand dirhams) and not exceeding AED 100,000 (one hundred thousand dirhams), or either of these two penalties, shall be imposed. Non- Disturbing Misdemeanor

Article (38) A penalty of imprisonment and a fine of not less than AED 100,000 (one hundred thousand dirhams) and not exceeding AED 300,000 (three hundred thousand dirhams), or either of these two penalties, shall be imposed on any person who: 1. Conducts any research or clinical study relating to genes, the human genome, or any of their applications to humans, where such research or study aims at human cloning, the modification of human characteristics of persons or embryos, or involves the risk of generating genetically modified living organisms that pose a risk to humans and the environment. 2. Publishes any research or studies containing data, information, or statistics relating to the Emirati Genome Program in contravention of the provisions of Clause (3) of Article (25) of this Decree by Law. Article (38) Penalty for Fleeing the Scene of an Accident and Failure to Provide Information A penalty of imprisonment for a period not exceeding one (1) year and a fine of not less than AED 50,000 (fifty thousand dirhams) and not exceeding AED 100,000 (one hundred thousand dirhams), or either of these two penalties, shall be imposed on any person who commits any of the following acts: 1. Failing, without an acceptable excuse, to stop when involved in a traffic accident caused thereby or occurring thereto resulting in injuries to persons. 2. Failure by the owner of a vehicle involved in the commission of a crime or an accident to provide information leading to the disclosure of the circumstances of the crime or accident or the identification of the person responsible therefor. 3. Fleeing from police officers when an attempt is made to stop them, or causing a pursuit on the road. 4. Deliberately colliding with vehicles of the Traffic Control Authority, military vehicles, or vehicles of security personnel while they are performing their duties. A penalty of imprisonment and a fine of not less than AED 5,000 (five thousand dirhams) and not exceeding AED 10,000 (ten thousand dirhams), or either of these two penalties, shall be imposed on any person who crosses the road at a place not designated for crossing if such act results in a traffic accident. 2. A penalty of imprisonment for a period of not less than three (3) months and a fine of not less than AED 10,000 (ten thousand dirhams), or either of these two penalties, shall be imposed on any person who crosses the road at a place not designated for crossing on roads where the prescribed speed limit is eighty (80) kilometers per hour or more. Acts as an intermediary, agent, or guarantor for any natural or legal person contracting with the Federal Entity in which they are employed, for the performance of any work or the provision of any service relating in any manner to the construction, maintenance, restoration, demolition, use, or transfer of ownership of any Union Property. 2. Uses Union Properties for personal purposes or for purposes other than those for which they are designated, whether such properties are under their custody or under the custody of another person. 3. Permits any person to use or exploit any Union Property, or to occupy any part thereof, in contravention of the cases permitted under any applicable legislation. Article (53) A penalty of imprisonment for a period not exceeding six (6) months and a fine of not less than AED 100,000 (one hundred thousand dirhams) and not exceeding AED 2,000,000 (two million dirhams), or either of these two penalties, shall be imposed on any person who: 1. Carries on an organized sporting activity other than through a declared or licensed sports entity. 2. Continues the activities of a sports entity that has lost its legal personality or whose license has been revoked or suspended, while being aware thereof. 3. Carries out an activity that conflicts with the purpose for which the declared sports entity was established, expends its funds in a manner that does not achieve such purpose, or causes financial loss thereto through negligence. 4. Draws up, maintains, or submits any document or record which this Law or the resolutions issued in implementation thereof require to be prepared, maintained, or submitted, containing false information while being aware thereof; deliberately conceals information which the Law or the resolutions issued in implementation thereof require to be recorded; or refrains from submitting the same to the concerned authorities. Article (54) A penalty of imprisonment and a fine of not less than AED 100,000 (one hundred thousand dirhams) and not exceeding AED 1,000,000 (one million dirhams), or either of these two penalties, shall be imposed on any player, coach, administrator, or referee who solicits, accepts, or receives, for themselves or for another, a gift, advantage, promise of anything of that nature with the intent of manipulating the outcome of a match, even if they did not intend to carry out such manipulation, or where the solicitation, acceptance, or receipt occurs after the manipulation of the match result. The briber and the intermediary shall be subject to the same penalty. In all cases, the offender shall be ordered to pay a fine equal to the value of what was solicited, accepted, or received, and the gift received by the offender shall be confiscated. The briber and the intermediary shall be exempt from punishment if they report the offence to the judicial authorities or any other concerned authority after its commission and before its discovery. Undertakes, without a license, any act involving the receipt, possession, use, transfer, alteration, disposal of, or dispersal of nuclear material which causes, or is likely to cause, death or serious injury to any person or material damage to property. 2. Steals nuclear material or obtains it unlawfully. 3. Embezzles nuclear material or obtains it by fraudulent means. 4. Attempts to obtain nuclear material through the use of force, threat, or any form of coercion or intimidation. 5. Threatens to use nuclear material to cause death or serious injury to any person, material damage to property, or to commit any other act of assault. 6. Commits any act in violation of the provisions of the International Convention for the Suppression of Acts of Nuclear Terrorism ratified by Federal Decree No. (95) of 2007 referred to herein. A penalty of imprisonment for a period of not less than one (1) year and not exceeding five (5) years, or a fine of not less than AED 100,000 (one hundred thousand dirhams) and not exceeding AED 500,000 (five hundred thousand dirhams), or either of these two penalties, shall be imposed on any person who violates the provisions of Article (64) of this Decree by Law. Article (251) Without prejudice to any more severe penalty, a penalty of imprisonment and a fine of not less than AED 5,000 (five thousand dirhams) and not exceeding AED 100,000 (one hundred thousand dirhams), or either of these two penalties, shall be imposed on any person entrusted with the affairs of a minor or a person in a similar position who commits any of the following acts: 1. Disposes of, embezzles, uses, dissipates, conceals, or otherwise deals with the property or documents of the minor or the person who is in a similar position to their detriment without the permission of the court, and such disposition is not subsequently approved by the court. 2. Article (268) Concealment of Books and Detrimental Acts Committed by the Debtor A debtor shall be deemed to have committed fraudulent bankruptcy, and shall be punished by imprisonment for a period not exceeding five (5) years and a fine not exceeding AED 1,000,000 (one million dirhams), or either of these two penalties, where a final judgment declaring their bankruptcy has been issued and it is established that, after cessation of payment, they committed any of the following acts: 1. Concealing, destroying, or altering all or part of their books with the intent of prejudicing their creditors. 2. Disposing of their assets after cessation of payment or after becoming financially insolvent, where such disposition is intended to place such assets beyond the reach of creditors. 3. Concealing part of their assets with the intent of prejudicing their creditors. 4. Acknowledging debts not due therefrom or reducing their assets while being aware thereof, whether such acknowledgement is made in writing, orally, in the balance sheet, or by refraining from submitting documents or explanations. 5. Article (269) Concealment of Books and Embezzlement by the Debtor's Managers The chairman and members of the board of directors of the company, its managers, auditors, liquidators, or persons responsible for its restructuring shall be punished by imprisonment for a period not exceeding five (5) years and a fine not exceeding AED 1,000,000 (one million dirhams), or either of these two penalties, where, after the issuance of a final decision commencing proceedings against the company, they commit any of the following acts: 1. Concealing, destroying, or altering all or part of the company's books. 2. Embezzling or concealing part of the company's assets. 3. Acknowledging debts that are not due from the company while being aware thereof, whether such acknowledgement is made in writing, orally, in the balance sheet, or by refraining from submitting documents or explanations in their possession while being aware of the consequences thereof. 4. Obtaining approval of a Preventive Settlement Proposal, a Restructuring Plan, or composition terms by means of fraud. 5. Making declarations contrary to the truth regarding the subscribed or paid-up capital, distributing fictitious profits, or appropriating any of the company's assets in the form of remuneration, where it is established that they knew at the time of such appropriation that they were not entitled to all or part thereof. Article (270) Bankruptcy by Negligence A debtor shall be deemed to have committed bankruptcy by negligence and shall be punished by imprisonment and a fine not exceeding AED 100,000 (one hundred thousand dirhams), or either of these two penalties, where their bankruptcy is declared by a final judgment and it is established that they have committed any of the following acts: 1. Spending excessive amounts on their personal or household expenses where such expenditure was among the causes of their cessation of payment. 2. Failing to keep commercial books sufficient to ascertain the true state of their financial position or failing to conduct the inventory required by law. 3. Refraining from providing information requested by the Trustee, the Bankruptcy Court, or the Court of Appeal. 4. Settling any indebtedness in a manner inconsistent with the conditions of the approved Preventive Settlement Proposal or Restructuring Plan, or disposing of any assets contrary to what is provided therein. 5. After cessation of payment, paying one creditor to the detriment of the others, or granting security or special advantages to a creditor in preference to the others, even if intended to obtain the majority approval required for a Preventive Settlement Proposal, a Restructuring Plan, or a composition. 6. Disposing of goods, assets, or rights at a price substantially below their market price or value with the intention of delaying cessation of payment, the declaration of bankruptcy, or the termination of a composition, Preventive Settlement Proposal, or Restructuring Plan, or resorting to unlawful means to obtain funds for that purpose. 7. Article (271) Fraudulent Behavior by Directors, Managers, and Liquidators Where a final judgment declaring the bankruptcy of a company is issued, the members of its board of directors, managers, and liquidators shall be punished by imprisonment and a fine not exceeding AED 500,000 (five hundred thousand dirhams), or either of these two penalties, where they commit any of the following acts: 1. Approving excessive remuneration for the members of the board of directors, the chief executive officer, or the managers during the three (3) years preceding the company's cessation of payment, where such remuneration was among the causes thereof. 2. Failing to keep commercial books sufficient to ascertain the true state of the company's financial position or failing to conduct the inventory required by law. 3. Refraining from providing information requested by the Trustee, the Bankruptcy Court, or the Court of Appeal, or intentionally providing incorrect information. 4. Disposing of the company’s assets after its cessation of payment with the intent of placing such assets beyond the reach of creditors. 5. Settling indebtedness in a manner inconsistent with the conditions of the approved Preventive Settlement Proposal or Restructuring Plan, or disposing of assets contrary to what is provided therein. 6. After the company's cessation of payment, paying one creditor to the detriment of the others, or granting security or special advantages to a creditor in preference to the others, even if intended to obtain the majority approval required for a Preventive Settlement Proposal, a Restructuring Plan, or composition terms. 7. A penalty of imprisonment for a period not exceeding five (5) years shall be imposed on any person who steals, embezzles, or conceals assets belonging to the debtor while being aware that a decision commencing bankruptcy proceedings has been issued against them, even if such person is the debtor's spouse, ascendant, descendant, or the ascendant or descendant of their spouse. 2. Article (275) Fraudulent Behavior of Creditors 1. A creditor of a debtor against whom a decision commencing proceedings has been issued shall be punished by imprisonment and a fine not exceeding AED 300,000 (three hundred thousand dirhams), or either of these two penalties, where such creditor commits any of the following acts: a. Fraudulently inflates the amount of their claim against the debtor. b. Stipulating for themselves, whether with the debtor or with another person, special advantages in consideration for voting in favor of the debtor at creditors' meetings. c. Entering into a secret agreement with the debtor after cessation of payment that grants them special advantages to the detriment of the other creditors while being aware thereof. 2. The Court shall declare the agreements referred to in paragraph (c) of Clause (1) of this Article null and void as against the debtor and any other person, and shall order the creditor to restore what they obtained under such void agreement, even if a judgment of acquittal is rendered. Article (277) Improper Acts of the Debtor A penalty of imprisonment and a fine not exceeding AED 500,000 (five hundred thousand dirhams), or either of these two penalties, shall be imposed on any debtor who commits any of the following acts: 1. Intentionally conceals all or part of their assets in order to obtain the majority approval required for a Preventive Settlement Proposal, a Restructuring Plan, or composition terms. 2. Intentionally enables a fictitious creditor, a creditor prohibited from participating in the proceedings, or a creditor who exaggerates the amount of his debt, to participate in deliberations and voting, or intentionally allowing such participation. 3. Article (279) Unlawful Participation in the Proceedings by a Non-Creditor A penalty of imprisonment for a period not exceeding one (1) year and a fine not exceeding AED 200,000 (two hundred thousand dirhams), or either of these two penalties, shall be imposed on: 1. Any person who is not a creditor and who participates in the deliberations or voting while being aware that they are not a creditor. 2. Any supervisor or Trustee who intentionally provides incorrect information regarding the debtor's condition, confirms such data, or discloses data of a confidential nature that came to their knowledge by reason of their appointment as supervisor or Trustee pursuant to this Law. Any person appointed by the Ministry, the Authority, or the Competent Authority to inspect a company who intentionally records false facts in the inspection report or intentionally omits material facts that may affect the outcome of the inspection. 2. The Chairman or a member of the board of directors of the company, the chief executive officer, or the general manager of the company who intentionally refrains from providing documents or information to the inspectors after the Ministry or the Authority has imposed the prescribed fine in this regard pursuant to the list of Administrative Penalties for acts committed in violation of the provisions of this Decree by Law issued by the Cabinet. Where rendering assistance exceeds the limits of their capability. b. Where rendering assistance would expose the vessel under their command, the seafarers, or the passengers to serious danger. Any member of the board of directors of a public joint- stock company who obtains, for themselves, their spouse, or any of their relatives up to the second degree, a loan, surety, or guarantee from the company on whose Board of Directors they serve, in violation of the provisions of this Decree by Law, together with an obligation to repay such loan, surety or guarantee. 2. The Chairman or any member of the board of directors of a public joint stock company, its chief executive officer, or its general manager who approves the granting of a loan, guarantee, or surety in favor of a member of the board of directors of the company, their spouse, or any of their relatives up to the second degree in violation of the provisions of this Decree by Law. Article (354) 1. A penalty of imprisonment for a period not exceeding three (3) months and a fine not exceeding the equivalent of three (3) months' wages, or either of these two penalties, shall be imposed on any member of the maritime crew who commits any of the following acts: a. Leaving the position assigned thereto aboard the vessel without a legitimate excuse before being relieved by their replacement. b. Absenting themselves from the vessel while assigned duties relating to navigation, steering, maneuvering, or watchkeeping. c. Failing, without a legitimate excuse, to be present on board the vessel at the time specified for departure procedures from any port other than the port of registration. d. Refusing to comply with an order issued thereto concerning the conduct of work aboard the vessel or the maintenance of order thereon. e. Engaging in repeated acts indicating insubordination. Non- Disturbing Misdemeanor 2. The penalty shall be imprisonment for a period not exceeding one (1) year where any of the offences referred to in Clause (1) of this Article is committed by more than three persons pursuant to a prior agreement among them. Any person who exploits data or information obtained from the founding committee at any stage of the company's incorporation, whether from legal or financial consultants, the subscription manager, the underwriter, parties participating in the incorporation procedures, or their representatives. 2. The Chairman or any member of the board of directors of the company, or any employee thereof, who exploits or discloses any of the company’s secrets or intentionally attempts to harm its business activities. Article (355) 1. A penalty of imprisonment shall be imposed on any person who assaults the Master of the vessel or one of its officers while performing their duties, or resists them by force, and the assault results in injuries. 2. The penalty shall be imprisonment for a period not exceeding one (1) year and a fine not exceeding AED 10,000 (ten thousand dirhams), or either of these two penalties, where the assault does not attain the degree of seriousness referred to in the preceding Clause. 3. The penalty shall be doubled where any of the offences referred to in this Article is committed by one of the vessel's officers or where such officer participates therein. 4. A fine of not less than AED 10,000 (ten thousand dirhams) shall be imposed on the Master of any vessel subject to compulsory pilotage where he engages a pilot knowing that the pilot is not authorized, or where they enter, navigate within, or depart from a pilotage area without using the services of a pilot, unless authorized to do so by the entity operating the pilotage service due to necessity. 2. In the event of recidivism, the penalty shall be imprisonment for a period not exceeding one (1) year and a fine of not less than AED 20,000 (twenty thousand dirhams), or either of these two penalties.
