A non-compete clause restricts a UAE employee, after leaving, from joining or starting a competing business. The Labour Law permits such clauses only where the employee had access to clients or business secrets, and requires them to be limited in time (capped at two years), geography, and type of work to what is genuinely necessary to protect the employer's legitimate interests. Overbroad clauses are routinely cut down or disregarded by UAE courts, and the employer bears the practical burden of proving real, quantifiable harm — speculative competition is not enough. Non-competes appear in most senior and sales contracts and drive a steady stream of disputes when employees move to rivals; they interact with work-permit transfers (MOHRE does not police non-competes, so enforcement happens in court via damages claims, not by blocking the new job). DIFC and ADGM apply their own employment rules to these clauses.
