    Article 1

    Article (1) This Regulation will be cited as "Regulation No. (4) of 2006 Concerning Tourist Desert Camps in the Emirate of Dubai".

    Article 2

    Article (2) In implementing the provisions of this Regulation, the following words and expressions will have the meaning indicated opposite each of them unless the context implies otherwise: DTCM: The Department of Tourism and Commerce Marketing. Tourist Establishment: An establishment owned by a natural or legal person which is licensed by the DTCM to organise inbound tours and/or incentive tourism activities. Tourist Desert Camp: A camp set up by a Tourist Establishment in desert or mountainous areas or in valleys in accordance with the requirements of the DTCM. Tourist Vehicle: A four-wheel drive vehicle that meets the technical inspection requirements and whose use for tourist transport is authorised. Private Desert Camp: One or more temporary tents set up for pleasure purposes for non-commercial use.

    Article (3) A Tourist Establishment may not set up a Tourist Desert Camp without obtaining a permit from the DTCM.

    Article (4) A permit for setting up a Tourist Desert Camp will be issued for a period of one (1) year or more. The permit will be valid throughout the validity of the commercial licence issued by the competent authorities in Emirate to the Tourist Establishment.

    Article 5

    Article (5) The DTCM will collect the annual fees stated in Schedule (1) attached hereto for setting up a Tourist Desert Camp. The DTCM will also collect fees for the remaining term of a Tourist Establishment licence calculated pro rata with the annual fee. For this purpose, a part of a month will be rounded up to a full month.

    Article 6

    Article (6) Where the inbound tour insurance policy does not cover risks that may occur at the Tourist Desert Camp, a Tourist Establishment must provide an insurance policy that covers all guests staying at the Tourist Desert Camp against any risks or incidents that they or their

This insurance policy must be valid throughout the validity of the licence and must expire one (1) month after expiry of the licence.

    Article 7

    Article (7) A Tourist Establishment authorised to set up a Tourist Desert Camp may not relocate that camp without the approval of the DTCM.

    Article 8

    Article (8) The Director General will establish the requirements for issuing permits to set up Tourist Desert Camps, and will have the power to exempt any Tourist Establishment from compliance with one or more of these requirements for a period not exceeding one (1) year.

    Article 9

    Article (9) The DTCM employees nominated by the Director General will, in the course of exercising their duties, have the capacity of law enforcement officers to record, and issue the relevant violation reports for, the acts committed in breach of the provisions of this Regulation, and any relevant bylaws and resolutions issued by the Director General.

    Article 10

    Article (10) The Director General or his authorised representative may impose one (1) or more of the administrative penalties prescribed in Schedule (2) attached hereto on any person who violates any of the provisions of this Regulation or the bylaws or resolutions issued in pursuance hereof.

    Article 11

    Article (11) A person on whom an administrative penalty is imposed may, by submitting a petition to the Director General, file a grievance against that penalty within fifteen (15) days from the date of being notified thereof. The Director General must determine the grievance within twenty-one (21) days of it submission and may dismiss or admit the grievance, and amend the penalty.

    Article 12

    Article (12) This Regulation will not apply to Private Desert Camps.

    Article (13) The Director General will issue the bylaws and resolutions required for the implementation of the provisions of this Regulation.

    Article (14) This Regulation will be published in the Official Gazette and will come into force three (3) months following the date of its publication.
