Injunction
الأمر القضائي
An injunction — in UAE practice usually referred to as a summary or precautionary order — is a court order requiring a party to do, refrain from doing, or preserve a state of affairs pending the resolution of a substantive dispute. The Civil Procedure Law (Federal Decree-Law No. 42 of 2022) and the summary orders section of that law authorise urgent orders to attach assets, suspend execution, prevent travel, prevent transfer of property, seize evidence, or safeguard a trademark or copyright, when there is a real risk that delay would prejudice a right. The applicant typically files ex parte, must show a genuine claim and urgency, and — for many orders — must provide a financial guarantee. DIFC and ADGM courts can grant common-law injunctions, including worldwide freezing and search orders.
