Article (1) This Regulation will be cited as “Regulation No. (5) of 2006 Concerning the Classification and Licensing of Tour Bust Establishments in the Emirate of Dubai.”

Article (2) The following words and expressions will have the meaning indicated opposite each of them unless the context implies otherwise: UAE: The United Arab Emirates. Emirate: The Emirate of Dubai. RTA: The Roads and Transport Authority. Executive Director: The executive director of the RTA. Person: A natural or legal person. Establishment: A company or corporation registered in the Emirate to conduct the activity of Tour Bus transport. ©2015 The Supreme Legislation Committee in the Emirate of Dubai 1Every effort has been made to produce an accurate and complete English version of this legislation. Competent Directorate: The Business Planning and Development Directorate of the Public Transport Agency of the RTA. Activity: The transport of passengers by Tour Buses to and from hotels, resorts, and major cultural and tourist destinations and landmarks within and outside of the Emirate according to determined timetables, routes, and Fare. Fare: The charges determined by the RTA for the services provided by an Establishment.

Article (3) No Person may conduct the Activity in the Emirate unless he obtains a licence from the RTA.

Article (4) The RTA will classify and license Establishments operating in the Emirate in the field of Tour Bus transport in accordance with the standards and rules it determines in this respect. For such purpose, the RTA may examine and inspect Establishments and their Tour Buses and report on their compliance with this Regulation and the resolutions issued in pursuance hereof. This includes verifying any violations committed by these Establishments and considering complaints filed against them.

Article (5) 1. Establishments operating in the field of Tour Bus transport will be classified according to categories approved by the RTA based on the volume of business of each Establishment, the number of Tour Buses it operates, and the number of its employees. 2. An applicant may, by submitting a written application to the Executive Director, challenge a classification decision within fifteen (15) days of being notified of such decision. This application must be determined within thirty (30) days of its submission. 3. Upon a written request of the owner of an Establishment to the Competent Directorate and based on new developments, the category of an Establishment may be modified pursuant to a resolution of the Executive Director. Such request must state the reasons for the modification and must be accompanied by all supporting documentation.

Article (6) The classification and licence of an Establishment will be valid for one or more years renewable for the same period on the same conditions, requirements, and procedures stated in the preceding articles. The application for classification or licence renewal must be submitted to the Competent Directorate thirty (30) days prior to expiry.

Article (7) Without prejudice to any requirements or obligations imposed by any other legislation, all Establishments must: 1. ensure that the technical specifications of their Tour Buses conform to the technical specifications of vehicles registered in the Gulf Cooperation Council countries, and that these buses are not more than ten (10) years old; 2. comply with legislation regulating road traffic, public health and safety, and environment; and any other legislation in force in the UAE; 3. use its Tour Buses exclusively for the Activity; 4. not operate more than five (5) Tour Buses unless an authorisation is obtained from the RTA; 5. provide the training prescribed by the RTA to Tour Bus drivers; 6. follow the Tour Bus routes and stop in the parking areas determined by the RTA; 7. observe the Fare chart and service timetables determined by the RTA; 8. not display commercial advertisements and stickers on the interior or exterior of Tour Buses; 9. inscribe the operation number, route number, destination, and telephone number for the purpose of reporting complaints and suggestions in a prominent place inside the Tour Bus; and 10. maintain the books, registers, and records of its activities, and provide the RTA with any statistics, documents, or data it deems necessary to access.

Article (8) The Competent Directorate will be responsible for preparing the requirements and instructions required for smooth workflow of Establishments, develop their performance, and examine and inspect Establishments and their buses with a view to verifying their compliance with the approved requirements and instructions.

Article (9) No licence holder may dispose of his licence in any manner including assigning it to third parties or adding a new partner unless the RTA’s approval is obtained.

Article (10) A licence holder must notify the Competent Directorate in writing in the event that he ceases his Activity.

Article (11) For the exigencies of public order and interest, the RTA may assess the impacts of Tour Bus transport and its effect on road traffic, road traffic safety, road users, public health and safety, and the environment. For this purpose, the RTA may take any procedures and measures it deems appropriate to remedy negative effects without any consequences, responsibilities, or liabilities on its part.

Article (12) Without prejudice to any stricter penalty stipulated in any other legislation, a person who violates the provisions of this Regulation, its implementing bylaw, or the resolutions issued in pursuance hereof will be punished by a fine of not less than five hundred Dirhams (AED 500.00) and not more than ten thousand Dirhams (AED 10,000.00). Upon repetition of the same violation within one (1) year from the date of the previous violation, the amount of the fine will be doubled and must not exceed the upper limit of a fine. In addition, the RTA may take one or more of the following measures against a violator: 1. revocation or suspension of licence for up to one (1) month; and/or 2. closing the Establishment.

Article (13) Employees and inspectors of the RTA nominated by a resolution of the Executive Director will have the capacity of law enforcement officers to record the acts committed in breach of the provisions of this Regulation, its implementing bylaw, and the resolutions issued in pursuance hereof. For this purpose, they may access the sites, premises, and Tour Buses of an Establishment, and the locations stipulated herein and review its records and entries to record violations or determine and seize the machinery, equipment, and material that are found in breach. They may also prepare the required violation reports.

Article (14) If a violator fails to remedy a violation or the damage resulting therefrom within the time frame prescribed by the Competent Directorate, the directorate may take any measure it deems appropriate to remedy such violation and redress such damage. The violator will incur expenses for the remedy in addition to ten per cent (10%) thereof as administrative fees.

Article (15) For the purpose of implementing the provisions of this Regulation, its implementing bylaw, and the resolutions issued in pursuance hereof, the Competent Directorate may seek assistance from Government departments and public authorities and corporations in the Emirate including police personnel. Such entities must provide assistance when so requested.

Article (16) The owner of an Establishment may, within two (2) weeks of being notified, file a grievance against an imposed penalty by submitting a petition to the Executive Director who will determine such petition within a week of it submission.

Article (17) The RTA will charge Establishments the classification, licensing, renewal, variation, assignment, partner addition, training, Tour Bus registration, and inspection fees stipulated in Schedule (1) attached hereto.

Article (18) The RTA will collect from Establishments fines for the violations stipulated in Schedule (2) attached hereto.

Article (19) The fees and fines collected pursuant to this Regulation will be paid to the RTA.

Article (20) All Persons conducting the Activity must comply with the provisions of this Regulation within one (1) year as from its effective date.

Article (21) The Executive Director will issue the implementing bylaw, resolutions, and instructions required for the implementation of this Regulation.

Article (22) Any provision in any other legislation will be repealed to the extent that it contradicts the provisions if the Regulation.
