    Article 1

    Article (1) Definitions Definitions provided in the Federal Law No. (9) of 2011 mentioned shall apply to this Resolution, otherwise, the following words and phrases shall have the meanings assigned to each of them, unless the context requires otherwise: Ministry : Ministry of Energy & Infrastructure. Minister : Minister of Energy & Infrastructure

    Article 2

    Article (2) Scope of Application This Resolution shall come into effect for anyone who violates the provisions of Federal Law No. (9) of 2011 regarding road transport and Executive Regulations thereof.

    Article 3

    Article (3) Administrative Violations and Sanctions Without prejudice to any more severe penalty stated in any other law or resolution, the Minister or whomever he authorises may impose administrative penalties on violators of the provisions of Federal Law No. (9) of 2011 regarding road transport and Executive Regulations thereof, and in accordance with the violations and penalties contained in the schedule attached hereby.

    Article 4

    Article (4) Grievance Every relevant person may grieve in writing to the Ministry against any of the aforementioned administrative fines in this Resolution that is imposed on that person within (15) fifteen days as of the date of notification of the grieved resolution, provided that the grievance shall be justified and all supporting documents shall be attached. Grievance shall be decided within (30) thirty days as of the date of submission pursuant to procedures applicable in the Ministry.

    Article 5

    Article (5) Collection of Administrative Fines Administrative fines shall be collected by the means decided by the Ministry of Finance.

    Article (6) Executive Resolutions The Minister shall issue the Resolutions necessary to apply the provisions of this Resolution.

    Article (7) Repeals Any provision that violates or contradicts the provisions of this Resolution shall be repealed.

    Article (8) Resolution Publication and Entry into Force This Resolution shall be published in the Official Gazette and shall be enforced after (90) ninety days as of the date of its publication.     Cabinet Resolution of 2022 on Violating the Provisions of Federal Law of 2011 Concerning Land Transport, its Executive Regulations, and the Administrative Penalties 4 Annex 1 Schedule of Violations and Administrative Penalties Annexed to Cabinet Resolution No. (67) of 2022 On Violating the Provisions of Federal Law Violations No. (9) of 2011 Concerning Road Transport, its Executive Regulations, and the Administrative Penalties No. Violation Description Administrative Penalty 1 The company undertakes any road transport activity for people and goods without obtaining a licence from the Ministry, or the company engages in an activity not included in the operating licence. 1. Administrative fine shall be (SAR 5,000) Five Thousand Dirhams. 2. In case of recidivism. a. The administrative fine shall be doubled b. The company licence shall be suspended if it was issued by the State for a period not exceeding (3) three months. 2 A road transport means transporting passengers or goods for a fee between the emirates of the state or between the state and neighbouring countries without a valid operating card. 1. Administrative fine shall be (SAR 2,000) Two Thousand Dirhams on the truck or bus. 2. Administrative fine shall be (SAR 5,000) Five Thousand Dirhams in case of repetition. 3 Employing a truck or bus driver who does not meet the conditions of work in the road transport activity subject to employment. 1. Administrative fine shall be (SAR 3.000) Three Thousand Dirhams. 2. Administrative fine shall be (SAR 5,000) Five Thousand

Administrative fine shall be (SAR 3.000) Three Thousand Dirhams. 5 Using a road transport means of transporting dangerous goods in violation of the activities licensed under the operating card. Administrative fine shall be (10,000) Ten Thousand Dirhams,. 6 Not keeping the operating card inside the means of road transport. Administrative fine shall be (SAR 500) Five Hundred Dirhams. 7 Not appointing a road transport agent licensed by the Ministry. Administrative fine shall be (SAR 2,000) Two Thousand Dirhams. 8 Obstructing the work of the Ministry inspectors. Administrative fine shall be (SAR 2,000) Two Thousand Dirhams. 9 Failure to provide the Ministry with the required data on the licensed activity. Administrative fine shall be (SAR 1.000) One Thousand Dirhams. 10 Failure of the licence holder to report to the Ministry within (10) ten working days as of the date of his being summoned to attend. Administrative fine shall be (SAR 2,000) Two Thousand Dirhams. 11 Failure to update the licensee data with the Ministry if it is changed. Administrative fine shall be (SAR 1.000) One Thousand Dirhams. 12 Transfer of ownership of a road transport means licensed by the Ministry Administrative fine shall be (SAR 2,000) Two Thousand

Dirhams. 13 Issuance of a customs traffic card company without a licence from the Ministry. Administrative fine shall be (SAR 2,000) Two Thousand Dirhams. 14 A company practicing the activity of a guarantor or car club without a prior licence from the Ministry. Administrative fine shall be (10,000) Ten Thousand Dirhams. 15 The carrier does not issue a ticket to each passenger during international transportation. Administrative fine shall be (SAR 1.000) One Thousand Dirhams. 16 The carrier does not issue a registration card for the passenger baggage. Administrative fine shall be (SAR 1.000) One Thousand Dirhams. 17 The means of transport not registered in the state loading goods from the state for the purpose of transporting it to a state other than the state in which it is registered, when it leaves the state without obtaining a permit from the Ministry. Administrative fine shall be (SAR 10,000) Ten Thousand Dirhams. 18 Transport operations are not covered by insurance from the beginning of the trip to its end. Administrative fine shall be (SAR 5.000) One Thousand Dirhams 19 The driver has exceeded the permitted working hours. Administrative fine shall be (SAR 5.000) Five Thousand Dirhams.
