Article (1) An exemption from compliance with the planning and construction determinants stipulated in the applicable planning and construction legislation of the Dubai Municipality may be granted, by increasing or decreasing horizontal or vertical construction parameters, in accordance with the rules prescribed pursuant to a resolution of the Director General of the Dubai Municipality.

Article (2) The applications for exemption referred to in the preceding Article will be subject to a fee calculated based on the following formula: 30% of the land plot price at the time of submitting the application x total area resulting from modification Total permitted built-up area ©2020 The Supreme Legislation Committee in the Emirate of Dubai 1 Every effort has been made to produce an accurate and complete English version of this legislation. However, for the purpose of its interpretation and application, reference must be made to the original Arabic text. In case of conflict, the Arabic text will prevail.

Article (3) The fee stipulated in this Regulation will not be charged in respect of applications submitted by UAE nationals where these applications are related to the construction of their private residences.

Article (4) This Regulation comes into force on the day on which it is issued, and will be published in the Official Gazette. Hamdan bin Mohammed bin Rashid Al Maktoum Chairman of the Executive Council Issued in Dubai on 19 December 2006 Corresponding to 28 Thu al-Qidah 1427 A.H.
