Found undisclosed structural cracks in a freehold apartment 8 months after purchase

Bought a 3BR in JBR last year. Cracks appeared in the master bedroom wall structural enough that the consultant says they were pre-existing, plastered over by the seller before viewing. What recourse against the seller?

This is fraudulent misrepresentation + breach of the implied condition of fitness under Article 246 of the UAE Civil Code. Get a registered consultant's report stating the cracks pre-dated the sale and were concealed. Then file a civil claim at Dubai Courts for rescission of sale (return of purchase price) OR damages equal to repair cost + diminution in value. The 10-year structural defect liability under Article 880 of the Civil Code also applies against the original developer if the building is under 10 years old.
