Article (1) Definitions In application of the provisions of this Resolution, the words and expressions set forth herein shall bear the meanings ascribed to them, unless the context otherwise requires: State : United Arab Emirates. Minister : Minister of Presidential Court. Committee : Supreme National Committee for Unified Procurement formed under the provisions hereof. Governmental Programs : Appropriations allocated by the government for medical, therapeutic or preventive services, provided free of charge or with a subsidy for specific categories, according to what the Committee decides. Unified Procurement : All procurement processes and arrangements for the needs of the State and federal and local governmental agencies and bodies of medicines, supplies and medical equipment subject to the provisions hereof. Supplies and Medical Equipment : Any device, instrument, mean, machine, apparatus, application, including implants, implantable devices, laboratory reagents for laboratory use, electronic software, material, or any other similar or related item, which the manufacturer has designed for human use, whether individually or in combination, for one or more medical purposes.

Article (4) The Committee’s Competences The Committee shall undertake the following duties: 1. Unify the procurement processes for governmental programmes within the health sector, encompassing medicines, supplies, medical equipment, and vaccinations. The relevant local authority shall oversee the procurement process at its own discretion and shall promptly notify the Committee of its proceedings. 2. Prepare a unified procurement system at the local level for health agencies, aiming to achieve financial savings, provide resources, and enhance the quality of the procurement processes for the governmental programmes.

Identify the needs of the governmental programmes and develop the requisite policies and procedures to effectively achieve objectives and tasks thereof. This shall be accomplished through analysing the market of medicines and medical supplies, determining the procurement priorities for the governmental programmes within the health sector, and overseeing the outcomes of tenders and negotiations with suppliers and manufacturers. 4. Collaborate with agencies associated with the governmental programmes within the health sector, suppliers, and manufacturers to enhance innovation, development, and the exchange of information and expertise in the field of medicines, supplies and medical equipment. 5. Contract with companies, agencies, and medical institutions, both domestically and internationally, for the procurement of medicines, equipment, and medical supplies, subject to the provisions hereof, for the benefit of the requesting agencies. The Committee shall delegate one of the public or private legal agencies to conclude such contracts after the Cabinet approval. 6. Propose the committee by-law concerning financial and administrative affairs and procurement regulations, provided the same shall be issued by a Resolution by the Minister; and 7. Any additional competences assigned thereto by the Cabinet or the Minister.

Article (6) The Committee’s Secretary-General The Committee shall have a Secretary-General appointed from among its members. The appointment shall be made by a resolution from the Minister, based on the recommendation of the Committee Chairman. The Secretary-General shall exercise, in particular, the following powers: 1. Prepare the agenda for the Committee meeting in consultation with the Committee Chairman and ensure its distribution to the Committee members in advance of the meeting. 2. Issue invitations to the Committee meetings in coordination with the Committee Chairman and members. Notify the members of the invitation personally and by email, fax, or any other means, at least one week prior to the scheduled meeting date, unless an alternative date is agreed upon by the members. 3. Designate the location for the meeting and prepare the attendance register and minutes of the meeting. 4. Have the meeting minutes and members notes approved by the Committee Chairman. 5. Retain the resolutions, recommendations, and meeting minutes. 6. Monitor the implementation of the committee resolutions and recommendations. 7. Represent the Committee before the judiciary and in external relations; and 8. Any additional tasks assigned thereto by the Minister or the Committee Chairman. The Presidency Office shall provide logistical services related to the Committee work.
