Article (1) Definitions The definitions set forth in the Federal Decree by Law No. (36) of 2023 Regarding the Regulation of Competition shall apply to the provisions of this Resolution. Unless the context requires otherwise, the following expression shall have the meaning assigned thereto: Decree by Law : Federal Decree by Law No. (36) of 2023 Regarding the Regulation of Competition.

Article (2) Service Fees The Ministry or the Concerned Authority, as the case may be, in accordance with their respective competences, shall collect, in consideration for the services provided in implementation of the provisions of the aforesaid Decree by Law, the fees prescribed in the following Schedule:

(5,000) 2 Submission of an application for exemption from the provisions of Article (6) regarding dominant position. (5,000) 3 Submission of an application for exemption from the provisions of Article (7) regarding economic dependency. (5,000) 4 Submission of an application for exemption from the provisions of Article (8) regarding predatory pricing. (5,000) 5 Submission of an Economic Concentration application. 0.02% of the aggregate annual sales value of the establishments participating in the Economic Concentration, provided that the fee shall not exceed AED 150,000. 6 Submission of an objection against an economic concentration transaction. (1,500) 7 Submission of a grievance against decisions issued pursuant to the provisions of the Decree by Law. 500, refundable if the grievance is upheld.

Article (3) Amendment of Service Fees The Cabinet shall have the authority to introduce any amendments to the services and fees set out in the Schedule annexed to this Resolution, whether by increasing, reducing, deleting, or changing the form of the fee, upon the proposal of the Minister of Finance, based upon the recommendation of the Minister, following coordination with the Concerned Authorities and the Committee.

Article (4) Collection of Service Fees 1. The Ministry shall collect the fees set out in this Resolution through the means determined by the Ministry of Finance, and such fees shall be credited to the Federal Government’s Treasury Single Account. 2. The Concerned Authority shall collect the fees set out in this Resolution, which shall be credited to the Local Government Treasury account, all in accordance with the mechanism in force in the relevant Emirate.

Article (5) Publication and Entry into Force of this Resolution This Resolution shall be published in the Official Gazette and shall enter into force thirty (30) days following the date of its publication.
