    Article (1) Definitions 1. For the purposes of implementing the provisions of this Resolution, the following terms and expressions shall have the meanings assigned to each of them, unless the context requires otherwise: State : The United Arab Emirates. Authority : The Emirates Authority for Standardization and Metrology (ESMA). Board : The Authority's Board of Directors. Director General : The Director General of the Authority. Competent Authorities : The federal and/or local governmental authority in the State entrusted with the implementation of the provisions of this System and the regulations issued pursuant thereto.

    Cabinet Resolution of 2013 Regarding the UAE Drinking Water Control System 2 Approved UAE Standard Specification : A document approved by the Board that defines the attributes of a product, material, or service, or anything subject to measurement, its descriptions, characteristics, quality level, dimensions, measures, or safety and security requirements. It also includes terms, symbols, testing methods, sampling, packaging, labels, and marks. It shall be referred to as " United Arab Emirates Standard Specification" and denoted by (UAE.S). Mandatory UAE Standard Specification (Technical Regulation) : An Approved UAE Standard Specification in respect of which a Cabinet Resolution has been issued mandating its application. Drinking Water : Water that is fit for human consumption, whether for direct drinking, cleaning, domestic cooking, or food manufacturing, which may be bottled or unbottled. Unbottled Drinking Water : Drinking water supplied to the consumer through the public network, a limited distribution network, wells, springs, or any other source of surface water used for drinking, to which all requirements stipulated in the Mandatory Approved UAE Standard Specification (Technical Regulation) for "Unbottled Drinking Water" (UAE.S GSO 149) apply. Bottled Drinking Water : Drinking water that has been treated and prepared for human consumption and packaged in suitable, tightly sealed containers, to which all requirements stipulated in the Mandatory Approved UAE Standard Specification (Technical Regulation) for "Bottled Drinking Water" (UAE.S GSO 1025) apply, and which does not include Bottled Natural Mineral Water.

    Cabinet Resolution of 2013 Regarding the UAE Drinking Water Control System 3 Bottled Natural Mineral Water : Water that is clearly distinguished from drinking water as defined in the approved Mandatory UAE Standard Specification (Technical Regulation) "Bottled Drinking Water" (UAE.S GSO 1025) as follows: − It is obtained directly from natural sources or from drilled artesian groundwater wells, which are protected to avoid any pollution that affects its natural and chemical quality; − It contains certain mineral salts in distinctive compositional proportions, along with the presence of some trace elements or other components; − The stability of its composition, its temperature, and the continuity of its flow, taking into account natural seasonal cycles; − It is obtained under conditions that ensure its original microbiological purity and the chemical composition of its basic components. − It has not been subjected to any treatment other than those permitted under the Mandatory UAE Standard Specification (Technical Regulation) for "Bottled Natural Mineral Water" (UAE.S GSO 987). − It is bottled in tightly sealed containers near the source, with the necessary health precautions being taken; − It conforms to all properties stipulated in the Mandatory UAE Standard Specification (Technical Regulation) for "Bottled Natural Mineral Water" (UAE.S GSO 987). Carbonated (Sparkling) Natural Mineral Water : Natural mineral water that, after bottling, contains free carbon dioxide gas, whether naturally present or added from another source.

    Cabinet Resolution of 2013 Regarding the UAE Drinking Water Control System 4 Non- Carbonated (Still) Natural Mineral Water : Natural mineral water that does not contain free carbon dioxide gas (whether naturally present or added, taking into account the permitted technical tolerance), in quantities exceeding those required to dissolve bicarbonate salts in the water. Degassed Natural Mineral Water : Natural mineral water whose carbon dioxide content after packaging is less than what is present at the source, and from which carbon dioxide is not spontaneously and visibly released under normal conditions of temperature and pressure. Treated Drinking Water : Water that has undergone treatment processes that depend on the degree of pollution of the water source, for the purpose of protecting the consumer from anything that harms human health. These processes include water collection, preliminary disinfection, sedimentation, filtration, final disinfection, and salinity reduction processes (Desalination). Well Water : Water obtained from an opening that is drilled, bored, or otherwise constructed in the ground, which reaches the water in a water- bearing layer. Spring Water : Water that naturally emerges from an underground cavity to the surface of the earth. The water shall be collected at the spring itself only, or through an opening leading to the groundwater stratum feeding the spring, which requires the presence of a natural force causing the water to flow to the surface through a natural opening, and the location of the spring shall also be identified. Artesian Well Water : Water obtained from a well-constructed in an underground water reservoir where the water level is slightly higher than the water reservoir's surface level. Artesian well water may be extracted with the assistance of an external force that supports the natural pressure below the earth's surface, as long as such procedures do not alter the physical properties or the composition and quality of the water.

    Cabinet Resolution of 2013 Regarding the UAE Drinking Water Control System 5 Ice : Ice obtained by the complete freezing of drinking water at a temperature not exceeding (-10°C) and formed in various shapes, such as blocks, cubes, or other shapes. Water Source : A source from which water is obtained, whether it is an artesian or coastal well, a dug well, a spring, a public or private water distribution system, or any other source containing water fit for human consumption. Public or Private Water Distribution System : Public or private water distribution systems supplying the consumer with water fit for direct consumption. Certificate of Conformity : The certificate issued by the Authority, which indicates the conformity of a product or a specific batch thereof, after ensuring that it fulfills the requirements of the Approved UAE Standard Specifications or the Mandatory UAE Standard Specifications (Technical Regulations). Emirates Quality Mark : A mark adopted by the Authority to indicate the conformity of a product with the Approved UAE Standard Specifications or the Mandatory UAE Standard Specifications (Technical Regulations) or any specification approved/adopted by the Authority, and the establishment's compliance with the conditions specified in the Emirates Quality Mark regulation. It is granted to the approved product upon the client's request. ECAS Conformity Assessment Module H (Full Quality Assurance) : A module that describes the procedure by which an establishment operates a recognized food safety system. This module includes product examination and assessment of the food safety system, and also includes periodic inspection and sampling from the market or the establishment, or both, to verify continued conformity.

    Cabinet Resolution of 2013 Regarding the UAE Drinking Water Control System 6 Supplier : The manufacturer, carrier, distributor, packager, assembler, processor, storer, agent, or the commercial or legal representative responsible for an imported product covered by this system, and any professional within the supply chain whose activity may have an effect on the characteristics of the product. Water-Related Electrical Appliances : Household appliances used in the processes of cooling, heating, and freezing drinking water. Electrical Equipment : Distillation equipment and electric pumps used in drinking water distribution systems. Pre-packaged Container : A product placed inside a box or wrapped in any way, the nominal or actual quantity of which has been determined and indicated on the label before being offered for sale or in the absence of the purchaser, and the actual quantity contained therein cannot be easily altered without opening it or making a tangible modification thereto. A pre-packaged container consists of the product and the wrapping material. Supply Chain : All stages that the product passes through, starting from primary production until it reaches the final consumer, including the stages of its import, export, manufacturing, preparation, processing, filling, wrapping, preparation, transportation, storage, distribution, offering, display, and sale. 2. The terminologies and definitions mentioned in the Approved UAE Standard Specifications shall form an integral part of this System, unless the context requires otherwise.

    Article (2) General Requirements for Drinking Water The Supplier shall ensure that the following requirements are met in Drinking Water:

Drinking Water shall be fit for human consumption and conform to the approved Mandatory UAE Standard Specifications (Technical Regulations) for each type, as specified in Annex No. (1) attached to this System. b. The Supplier shall implement one of the internationally recognized food safety management systems accepted by the Authority. c. The Supplier shall observe good hygienic practices in a manner that does not contravene the Mandatory UAE Standard Specification (Technical Regulation) "General Principles of Food Hygiene" No. (UAE.S GSO 1694) and the Mandatory UAE Standard Specification (Technical Regulation) "Hygienic Regulations for Food Plants and Their Personal" No. (UAE.S 21 GSO), as specified in Annex (1) attached to this System. 2. Requirements related to collection, treatment, filling, storage, transport, and distribution of Drinking Water: The Supplier (excluding the supplier dealing in natural mineral water) shall comply with the implementation of the provisions stipulated in the Mandatory UAE Standard Specification (Technical Regulation) "Code of Hygienic Practice for Bottled Drinking Water (Other than Natural Mineral Water)" No. (UAE.S GSO 1928), as specified in Annex (1) attached to this System. 3. Requirements related to metrology: When selling quantities of water, the Supplier shall adhere to the measurement units represented by the cubic meter or liter, or their multiples or sub-multiples only. 4. Requirements related to methods of testing Drinking Water: a. The Supplier shall ensure the conformity of the Drinking Water to verify its fitness according to the testing methods stipulated in the Approved UAE Standard Specifications or according to the Gulf, international, or regional standard specifications or any other specification approved by the Authority. In the absence of specifications for the required tests, the tests may be conducted according to validated and internationally accepted testing methods, with scientific evidence available on the validity of their results.

    Article (3) Requirements for Unbottled Drinking Water 1. The Supplier shall ensure that the following requirements are met in Unbottled Drinking Water: a. Requirements related to safety and quality: Unbottled Drinking Water shall comply with all requirements stipulated in the Mandatory UAE Standard Specification (Technical Regulation) "Unbottled Drinking Water" No. (UAE.S GSO 149), as specified in Annex (1) attached to this System. b. Requirements related to metrology: In addition to the provisions stipulated in Paragraph (3) of Article (2) of this Resolution, Unbottled Drinking Water shall be sold by means of measuring devices or tankers verified by the Authority in accordance with the Approved UAE Standard Specification No. (UAE.S GSO OIML R 49-1) and the UAE standard specification No. (UAE.S GSO OIML R 80-1), as specified in Annex (2) attached to this System. 2. The Competent Authorities shall verify the conformity of Unbottled Drinking Water with the Approved Standard Specifications or the Mandatory UAE Standard Specifications (Technical Regulations) in accordance with the provisions of this System and the resolutions issued in implementation thereof. 3. The Competent Authorities may take samples from all supply points of Unbottled Drinking Water to conduct the appropriate tests and verify their safety throughout the entire Supply Chain and their conformity with the requirements stipulated in this System.

    Article (4) Requirements for Bottled Drinking Water 1. The Supplier shall ensure that the following requirements are met in Bottled Drinking Water:

    Cabinet Resolution of 2013 Regarding the UAE Drinking Water Control System 9 First: Labeling Requirements The label on bottled drinking water containers shall comply with the requirements stipulated in the Mandatory UAE Standard Specification (Technical Regulation) "Labeling of Prepackaged Foodstuffs" No. (UAE.S GSO 9) in general, in addition to the explanatory data specified in the Mandatory UAE Standard Specification (Technical Regulation) "Bottled Drinking Water" No. (UAE.S GSO 1025) and the explanatory data specified in the Mandatory UAE Standard Specification (Technical Regulation) "Bottled Natural Mineral Water" No. (UAE.S GSO 987), as specified in Annex (1) attached to this System. Second: Safety and Quality Requirements a. Bottled Drinking Water shall comply with the requirements stipulated in the Mandatory UAE Standard Specification (Technical Regulation) "Bottled Drinking Water" No. (UAE.S GSO 1025), as specified in Annex (1) attached to this System. b. Bottled Natural Mineral Water shall comply with the requirements stipulated in the Mandatory UAE Standard Specification (Technical Regulation) "Bottled Natural Mineral Water" No. (UAE.S GSO 987), as specified in Annex (1) attached to this System. c. Edible ice shall comply with the requirements stipulated in the Mandatory UAE Standard Specification (Technical Regulation) " Edible Ice" No. (UAE.S GSO 384), as specified in Annex (1) attached to this System. Third: Expiration Date Requirements for Bottled Drinking Water The expiration date of bottled water shall be in accordance with what is stipulated in the Mandatory UAE Standard Specification (Technical Regulation) "Expiration Date for Food Products" No. (UAE.S GSO 150), as specified in Annex (1) attached to this System. Fourth: Storage Requirements for Bottled Drinking Water Bottled Drinking Water shall be stored in accordance with the requirements stipulated in the Mandatory UAE Standard Specification (Technical Regulation) "Requirements of Storage Facilities for Dry and Canned Food" No. (UAE.S GSO 168), as specified in Annex (1) attached to this System, and as stipulated in the specific approved standard specifications for each type of water. Fifth: Metrological Requirements for Bottled Drinking Water: In addition to what is stipulated in Paragraph (3) of Article (2) of this System, the quantities of

    Cabinet Resolution of 2013 Regarding the UAE Drinking Water Control System 10 product in Bottled Drinking Water containers shall meet the requirements stipulated in the Approved UAE Standard Specification No. (UAE.S GSO OIML R 87), as specified in Annex (2) attached to this System. Sixth: Requirements for Packaging Materials and Materials in Contact with Bottled Drinking Water The packaging and wrapping materials for Bottled Drinking Water containers shall comply with the requirements stipulated in the Mandatory UAE Standard Specification (Technical Regulation) "Food Packages - Part 1: General Requirements" No. (UAE.S GSO 839), and the Mandatory UAE Standard Specification (Technical Regulation) "Food Packages - Part 2: Plastic Packages - General Requirements" No. (UAE.S GSO 1863), as specified in Annex (1) attached to this System. Seventh: Conformity Assessment and Conformity Marks: a. All locally produced or imported Bottled Drinking Water shall be subject to the Full Quality Assurance module (Module H), the requirements of which are specified in the Emirates Conformity Assessment System (ECAS). b. All Bottled Drinking Water containers placed on the market in the State shall bear the Emirates Quality Mark or any mark recognized by the Authority in respect of imported containers. 2. Control of Imported Bottled Water: a. Imported Bottled Drinking Water shall be verified by the availability of the Emirates Quality Mark or any mark recognized by the Authority in accordance with the Full Quality Assurance module (H), the requirements of which are specified in the Emirates Conformity Assessment System (ECAS). b. The Competent Authorities shall have the right to take representative samples of imported Bottled Drinking Water to conduct the tests they deem appropriate to determine the extent of its conformity with this System. 3. Market Surveillance: The Authority and the Competent Authorities shall have the right to withdraw the necessary samples from the Supply Chain of Bottled Drinking Water to conduct the necessary tests to ensure the safety of the Bottled Drinking Water and its conformity with the requirements

    Article (5) Requirements for Electrical Appliances and Filters Used with Drinking Water The Supplier shall ensure that the following requirements are met in electrical appliances and filters used with Drinking Water: 1. Electrical Appliances: a. The requirements stipulated in the Approved UAE Standard Specification No. (UAE.S GSO 1811), as specified in Annex (2) attached to this System, shall be met in Drinking Water coolers, and they shall have obtained a Certificate of Conformity, the Emirates Quality Mark, or any certificate of conformity or mark recognized by the Authority in respect of imported packages. b. The requirements stipulated in the Mandatory UAE Standard Specification (Technical Regulation) "Household and Similar Electrical Appliances- Safety - Part 2-24: Particular Requirements for Refrigerating Appliances, Ice-Cream Appliances and Ice-Makers" No. (UAE.S GSO IEC 60335-2-24), as specified in Annex (1) attached to this System, shall be met in Drinking Water freezers, and they shall have obtained a Certificate of Conformity, the Emirates Quality Mark, or any certificate of conformity or mark recognized by the Authority in respect of imported packages. 2. Filters: The requirements stipulated in the Approved UAE Standard Specification No. (UAE.S GSO 2071) "Jug Water Filter for Household Uses," as specified in Annex (2) attached to this System, shall be met for Drinking Water filters, and they shall have obtained a Certificate of Conformity, the Emirates Quality Mark, or any certificate of conformity or mark recognized by the Authority in respect of imported packages.

    Article (6) Requirements for Pipes, Valves, and Fittings Used for Drinking Water The Supplier shall ensure that pipes, valves, and fittings used for drinking water comply with

Welded and seamless galvanized steel water pipes shall comply with all requirements stipulated in the Mandatory UAE Standard Specification (Technical Regulation) No. (UAE.S GSO 492), as specified in Annex (1) attached to this System. b. Welded and seamless non-galvanized steel water pipes shall comply with all requirements stipulated in the Approved UAE Standard Specification No. (UAE.S GSO ISO 4200), as specified in Annex (2) attached to this System. c. Water pipes manufactured from ductile iron shall comply with all requirements stipulated in the Approved UAE Standard Specifications No. (UAE.S GSO 1840) and No. (UAE.S GSO 2531), as specified in Annex (2) attached to this System. d. Copper water tubes shall comply with all requirements stipulated in the Approved UAE Standard Specification No. (UAE.S GSO EN 1057), as specified in Annex (2) attached to this System. 2. Requirements for Non-Metal Pipes: a. Plastic water pipes manufactured from unplasticized polyvinyl chloride (UPVC) shall comply with all requirements stipulated in the Mandatory UAE Standard Specification (Technical Regulation) No. (UAE.S GSO 675), as specified in Annex (1) attached to this System, and the Approved UAE Standard Specification No. (UAE.S GSO ISO 3114), as specified in Annex (2) attached to this System. b. Plastic water pipes manufactured from polypropylene (PP) shall comply with all requirements stipulated in the Approved UAE Standard Specification No. (UAE.S GSO ISO 15874), including all its parts, as specified in Annex (2) attached to this System. 3. Requirements for Valves: a. Globe valves shall comply with all requirements stipulated in the Approved UAE Standard Specifications No. (UAE.S GSO EN 13789) and No. (UAE.S GSO EN 13709), as specified in Annex (2) attached to this System. b. Gate valves shall comply with all requirements stipulated in the Approved UAE Standard Specifications Nos. (UAE.S GSO EN1984), (UAE.S GSO EN 14341), and (UAE.S GSO EN1171), as specified in Annex (2) attached to this System.

Requirements for Fittings: Fittings shall comply with all requirements stipulated in the Mandatory UAE Standard Specification (Technical Regulation) No. (UAE.S GSO 1184), as specified in Annex (1), and in the Approved UAE Standard Specification No. (UAE.S GSO ISO 2531), as specified in Annex (2) attached to this System. 5. Conformity Assessment: a. All pipes, valves, and fittings used for Drinking Water shall be subject to Conformity Module B for product verification, the requirements of which are set out in the Emirates Conformity Assessment System (ECAS). b. All pipes, valves, and fittings used for Drinking Water placed on the market in the State shall obtain a Certificate of Conformity from the Authority in accordance with Conformity Module B. 6. Market Surveillance: The Authority or the Competent Authorities shall have the right to withdraw samples from the market and carry out such tests as they deem appropriate to ensure the conformity of pipes, valves, and fittings with the conditions stipulated in this System.

    Article (7) Requirements for Tanks, Tankers, and Vehicles for the Transport and Distribution of Drinking Water The Supplier shall ensure that tanks, tankers, and vehicles for the transport and distribution of drinking water comply with the following requirements: 1. Requirements for Drinking Water Tanks: a. Household water storage tanks manufactured from galvanized mild steel sheets shall comply with the requirements stipulated in the Mandatory UAE Standard Specification (Technical Regulation) No. (UAE.S GSO 588), as specified in Annex (1) attached to this System. b. Drinking water tanks manufactured from polyester resins reinforced with fiberglass shall comply with the requirements stipulated in the Mandatory UAE Standard

    Cabinet Resolution of 2013 Regarding the UAE Drinking Water Control System 14 Specification (Technical Regulation) No. (UAE.S GSO 459), as specified in Annex (1) attached to this System. c. Drinking water tanks shall comply with all requirements stipulated in the Approved UAE Standard Specification No. (UAE.S GSO R71), as specified in Annex (2) attached to this System. 2. Technical Requirements for Vehicles Used for the Transport and Distribution of Bottled Drinking Water: Vehicles for the transport and distribution of Bottled Drinking Water shall be designated solely for the transport of foodstuffs only and shall comply with the requirements specified by the Competent Authorities. 3. Requirements for Tankers Used for the Transport and Distribution of Unbottled Drinking Water: a. Tanker trucks designated for the transport of Unbottled Drinking Water shall comply with the requirements stipulated in the Approved UAE Standard Specification "Motor Vehicles - Requirements for Tankers for the transport of Drinking Water" No. (UAE.S GSO 2025), as specified in Annex (2) attached to this System. b. Vehicles for the transport and distribution of Bottled Drinking Water and tankers for the transport and distribution of Unbottled Drinking Water shall be licensed by the Competent Authority. 4. Requirements for Measurements: a. The capacity of water tankers shall be in whole-number multiples of one cubic meter only. b. The capacity of water tanks shall be expressed in cubic meters or liters. c. The maximum permissible shortfall for tankers and tanks shall be in accordance with the Approved UAE Standard Specification No. (UAE.S GSO OIML R 80-1), as specified in Annex (2) attached to this System. d. The tanker's tank shall be verified prior to its first use and upon any modification affecting its capacity. e. Water meters shall comply with the requirements stipulated in the Approved UAE Standard Specification No. (UAE.S GSO OIML R 49-1), as specified in Annex (2)

Conformity Assessment: All Drinking Water tanks and tankers shall be subject to Conformity Module B, the requirements of which are specified in the Emirates Conformity Assessment System (ECAS). 6. Market Surveillance: The Authority or the Competent Authority shall have the right to carry out such tests as it deems appropriate to verify their conformity with the requirements stipulated in this System.

    Article (8) Procedures and Penalties 1. In the event of any violation of the provisions of this System being detected, the Competent Authority shall take the necessary measures to remove the violation and its effects from the market, and for that purpose may: a. Require the violating entity responsible for placing the non-compliant product on the market to withdraw it for the purpose of rectifying its status, re-exporting it to the country of origin, or destroying it, within a period specified by the Competent Authority. b. Take all necessary measures to withdraw such products from the market, seize them, destroy them, or take any other necessary measures to remove this violation. The Competent Authority may also announce the withdrawal of the product from the market, with all resulting costs to be borne by the violating entity. 2. Without prejudice to any more severe penalty stipulated in other laws, anyone who violates the provisions of this System shall be subject to the penalties stipulated in Federal Law No. (28) of 2001 Regarding the Establishment of the Emirates Authority for Standardization and Metrology, as amended.

    Article (9) Transitional Provisions 1. The Supplier shall, within a period of (180) days from the date of publication of this

    Cabinet Resolution of 2013 Regarding the UAE Drinking Water Control System 16 System in the Official Gazette, obtain the approval of the Authority to affix the Emirates Quality Mark or any mark recognized by the Authority to imported packages. 2. The circulation of water containers that do not conform to the capacities and units specified in this System and that are currently available in the markets shall be permitted for a period not exceeding two years from the date of publication of this System in the Official Gazette.

    Article (10) Final Provisions 1. Annexes (1) and (2), which include the Mandatory UAE Standard Specifications and the Approved UAE Standard Specifications necessary for this System, shall form an integral part of its provisions, and the Authority shall update them whenever the need arises in accordance with the provisions of Federal Law No. (28) of 2001 Regarding the Establishment of the Emirates Authority for Standardization and Metrology, as amended. 2. The Approved UAE Standard Specifications listed in Schedule No. (2) annexed to this System shall be deemed mandatory for application in the State solely for the purposes of implementing this System. 3. The Board may adopt any other Standard Specifications required for the implementation of the provisions of this System. 4. The Authority shall establish the necessary procedures for the implementation of the articles of this System and may delegate any of the Competent Authorities to carry out the supervision of the products subject to this System under its oversight. 5. This System shall not prevent the inspectors of the Competent Authorities or other official authorities from conducting any other tests to ensure the conformity of the products subject to this System with the mandatory requirements stipulated in other laws and technical regulations. 6. All entities subject to the provisions of this System shall provide the inspectors of the Competent Authorities with all the assistance and information requested thereby in connection with the implementation of the provisions of this System. 7. Where any situation arises that cannot be addressed under the provisions of this System,

    Cabinet Resolution of 2013 Regarding the UAE Drinking Water Control System 17 or any dispute arises regarding its interpretation or application, the matter shall be referred to the Director General to issue the decision they deem appropriate in respect of such situation or dispute, in a manner that achieves the public interest.

    Article (11) Repeals Any provision that contradicts or conflicts with the provisions of this Resolution is hereby repealed.

    Article (12) Publication and Entry into Force This Resolution shall be published in the Official Gazette and shall enter into force (180) days after the date of its publication, and the Concerned Authorities shall implement its provisions.
