    Title of the Law: the Law

    المادة 1

    Article (1) This Law will be cited as “Law No. (12) of 2015 Concerning the Dubai Corporation for Ambulance Services”. ©2015 The Supreme Legislation Committee in the Emirate of Dubai 1Every effort has been made to produce an accurate and complete English version of this legislation. However, for the purpose of its interpretation and application, reference must be made to the original Arabic text. In case of conflict the Arabic text will prevail.

    Title of the Law: the Law

    المادة 2

    Article (2) The following words and expressions, wherever mentioned in this Law, will have the meaning indicated opposite each of them unless the context implies otherwise: Emirate: The Emirate of Dubai. Ruler: His Highness the Ruler of Dubai. Government: The Government of Dubai. Executive Council: The Executive Council of the Emirate of Dubai. DCAS: The Dubai Corporation for Ambulance Services. Board of Directors: The board of directors of the DCAS. Chairman: The chairman of the Board of Directors. Executive Director: The executive director of the DCAS. Establishment: A company or corporation authorised by the DCAS to provide Ambulance Services in the Emirate. Ambulance Services: These include the prehospital medical services rendered to the injured and patients; transport of patients between healthcare facilities; and provision of training on these services. Emergency Medicine: The medical measures and procedures for treatment of the injured and patients in cases requiring immediate care to sustain their lives. Professional: A natural person authorised by the DCAS to provide any of the Ambulance Services in the Emirate. Emergency Case: A medical condition or sudden injury warranting immediate medical intervention to save a person’s life or to eliminate a threat to his wellbeing. First Aid: The first help given to the injured at a place of accident by persons who are aware of the rules and procedures for providing aid in emergencies, until the arrival of qualified ambulance Professionals.

    Article (3) The provisions of this Law will apply to the DCAS established pursuant to the above-mentioned Law No. (13) of 2006 as a public corporation having legal personality, and the legal capacity required to undertake all acts and dispositions that ensure the achievement of its objectives.     Article (4) The head office of the DCAS will be located in the Emirate, and the DCAS may establish branches within and outside of the Emirate. Objectives of the DCAS

    Article (5) The DCAS will have the following objectives: 1. to improve Ambulance Services in the Emirate in line with the approved strategic plans and best international practices; 2. to promptly respond to all Emergency Cases; 3. to efficiently and effectively contribute to disaster and crisis management; 4. to support and encourage continued and specialised education and training for persons engaged in Ambulance Services; 5. to increase community awareness of First Aid and of the importance of Emergency Medicine; and 6. to regulate the work of Ambulance Service Providers in the Emirate, and improve Ambulance Services Establishments and develop the abilities of their personnel. Functions of the DCAS

    Article (6) For the purpose of achieving its objectives, the DCAS may: 1. develop, update, and oversee, in coordination with the concerned entities, the implementation of, the policies and comprehensive strategic plans related to Ambulance Services in the Emirate;

    Law No. (12) of 2015 Concerning the Dubai Corporation for Ambulance Services Page 4 of 8 2. contribute to setting and developing an integrated strategy, and a standardised crisis and disaster management policy in the Emirate; 3. manage and operate a command and control centre for Ambulance Services in the Emirate; 4. provide and regulate Ambulance Services within the Emirate. The DCAS may provide Ambulance Services outside of the Emirate in case of national disasters or crises, or upon the request of federal or local authorities in the UAE; 5. provide free Ambulance Services at official events organised by Government entities; 6. provide Ambulance Services at sports, economic, social, and other events organised in the Emirate for the relevant fees prescribed by the DCAS; 7. propose the legislation that contributes to improving the level of Ambulance Services in the Emirate, and submit the same to the competent entities for consideration and approval; 8. propose fees and charges for the services rendered by the DCAS, and submit the same to the competent entities for approval; 9. increase awareness among members of the community of First Aid and the importance of Ambulance Services in protecting human life and safety; and organise and supervise volunteer work in the field of Ambulance Services; 10. authorise Establishments to provide Ambulance Services in the Emirate in accordance with the legislation in force; 11. grant, in accordance with the relevant rules and standards adopted by the DCAS, “no- objection” certificates to issue licences to ambulance vehicles authorised to operate in the Emirate; 12. license Professionals working in Establishments in accordance with the relevant rules and standards adopted by the DCAS; 13. authorise, in accordance with the relevant rules and standards adopted by the DCAS, basic and advanced First Aid training centres to provide their services in the Emirate; 14. audit, supervise, and take the necessary action in respect of Establishments and Professionals in accordance with the legislation in force in the Emirate; 15. establish an academy specialising in developing and providing academic and training programmes in all fields of Emergency Medicine and Ambulance Services, and award the relevant academic certificates;

    Law No. (12) of 2015 Concerning the Dubai Corporation for Ambulance Services Page 5 of 8 16. prepare and provide the concerned entities with manuals, guidelines, and instructions on the provision of First Aid services at various work sites in the Emirate; 17. cooperate and participate with entities and individuals within and outside of the Emirate in all matters related to its work; and conclude the required contracts, agreements, and memoranda of understanding; 18. participate in local and international conferences and specialised workshops on the provision of Ambulance Services, and organise such conferences and workshops in the Emirate; and 19. perform any other duties required for the achievement of its objectives.     Article (7) The DCAS will have a Board of Directors comprised of a Chairman, a vice chairman, and a number of members representing the concerned entities in the Emirate, appointed by a decree of the Ruler. Functions of the Board of Directors

    Article (8) a. The Board of Directors is the highest authority in charge of general supervision and management of the affairs of the DCAS and, in particular, it will have the duties and powers to: 1. approve the general policy and strategic and development plans of the DCAS; 2. approve the draft annual budget and final accounts of the DCAS, and submit the same to the competent entities for final approval; 3. approve the resolutions regulating the administrative, financial, and technical work of the DCAS; 4. approve the organisational structure of the DCAS and submit the same to the Executive Council for final approval; 5. form and determine the duties of permanent and temporary sub-committees and work teams; 6. review the annual performance reports of the DCAS and pass the required relevant resolutions; 7. approve the standards of professional development for those engaged in providing Ambulance Services in the Emirate; and

The Board of Directors may delegate any of its powers stipulated in paragraphs (a)(3) and (a)(7) of this Article to any of its members or to the Executive Director, provided that the delegation is in writing and specific. Meetings of the Board of Directors

    Article (9) a. The Board of Directors will convene at the invitation of the Chairman, or in his absence by the vice chairman, at least twice a year, and where required. Meetings of the Board of Directors will be valid if attended by the majority of its members, provided that the Chairman or vice chairman of the Board of Directors is in attendance. b. Resolutions of the Board of Directors will be passed by majority vote of attending members, and in the event of a tie, the chair of the meeting will have a casting vote. Resolutions and recommendations of the Board of Directors will be recorded in minutes of meetings signed by the chair of the meeting and attending members. c. A rapporteur will be appointed to the Board of Directors by the Chairman. The rapporteur will send invitations to the meetings of the Board of Directors, prepare its meeting agendas, record minutes of its meetings, follow up the implementation of its resolutions and recommendations, and perform any other duties assigned to him by the Chairman.     Article (10) The executive body of the DCAS will be comprised of the Executive Director and a number of employees to whom Law No. (27) of 2006 Concerning Management of the Government of Dubai Human Resources and its amendments will apply. Executive Director

    Article (11) a. The Executive Director will be appointed by a resolution of the Chairman of the Executive Council. b. The Executive Director will directly responsible to the Board of Directors for performing the duties assigned to him pursuant to this Law and the resolutions issued in pursuance hereof, and for performing the duties assigned to him by the Board of Directors.

    Article (12) The Executive Director will undertake the direct supervision of the work of the DCAS, and, in particular, he will have the duties and powers to: 1. propose the general policy and strategic and development plans of the DCAS; submit the same to the Board of Directors for approval; and follow up their implementation; 2. approve the operational plans required for the implementation of the general policy and strategic and development plans of the DCAS; 3. propose the resolutions regulating the financial, administrative, and technical work of the DCAS, and submit the same to the Board of Directors for approval; 4. prepare the draft annual budget and final accounts of the DCAS, and submit the same to the Board of Directors for approval; 5. propose the organisational structure of the DCAS, and submit the same to the Board of Directors for approval; 6. propose the standards of professional development for those engaged in providing Ambulance Services in the Emirate, and submit the same to the Board of Directors for approval; 7. supervise the executive body of the DCAS, and the work, activities, and services performed by the executive body; 8. supervise the implementation of the projects and programmes conducted by the DCAS; 9. represent the DCAS before third parties, and execute the contracts, agreements, and memoranda of understanding to which the DCAS is party; and 10. perform any other duties assigned or delegated to him by the Board of Directors. Financial Resources of the DCAS

    Article (13) The financial resources of the DCAS will consist of: 1. the support allocated to the DCAS in the general budget of the Government; and 2. any other resources approved by the Executive Council.

    Article (14) In regulating its accounts and records, the DCAS will apply the rules and principles of government accounting. The financial year of the DCAS will commence on 1 January and will end on 31 December of each year. Issuing Implementing Resolutions

    Article (15) The Board of Directors will issue the resolutions required for the implementation of the provisions of this Law. Repeals

    Article (16) a. This Law hereby supersedes the above-mentioned Law No. (13) of 2006. b. Any provision in any other legislation will be repealed to the extent that it contradicts the provisions of this Law. Commencement and Publication
