    المادة 1

    Article (1) The following words and expressions, wherever mentioned in this Decree, will have the meaning indicated opposite each of them unless the context implies otherwise: Emirate: The Emirate of Dubai. ©2019 The Supreme Legislation Committee in the Emirate of Dubai 1Every effort has been made to produce an accurate and complete English version of this legislation. However, for the purpose of its interpretation and application, reference must be made to the original Arabic text. In case of conflict, the Arabic text will prevail.

Vehicle: Any motorised machine, motorcycle, carriage, or other machine designed to run on roads, whether mechanically propelled or otherwise. This includes heavy Vehicles and Recreational Motorcycles. Recreational Motorcycle: A two- or more-wheeled motor Vehicle licensed for use in all terrains, except paved Roads. Road: Any public way on which Vehicles are allowed to travel, including all roads, public squares, bridges, public car parks, pavements, and pedestrian crossings. Cases of Mandatory Administrative Impoundment of Vehicles

    Article (2) Without prejudice to the penalties and measures prescribed by the legislation in force in the Emirate, a Vehicle will be impounded by the Police in the following cases: 1. participating in a Road race without first obtaining a permit from the Police; 2. riding the Recreational Motorcycle on a paved Road; 3. making substantial modifications to the Vehicle which result in increasing its speed limit or making loud sounds or noise when operating or driving it; 4. issuing traffic fines in excess of six thousand Dirhams (AED 6,000.00) against the Vehicle; 5. driving the Vehicle with an expired licence after the lapse of three (3) months from expiry of the same, without any valid reason; 6. driving the Vehicle recklessly or in a manner that compromises the safety of others; or 7. escaping from the Police personnel.

    Article (3) Without prejudice to the penalties and measures prescribed by the legislation in force in the Emirate, the General Commander or his authorised representative may, based on a traffic violation report, impound a Vehicle in any of the cases indicated in the Schedule attached to this Decree, in which case the period of impoundment must not exceed the period indicated opposite to the relevant case. Release of Vehicles Subject to Mandatory or Discretionary Administrative Impoundment

    Article (4) a. A Vehicle impounded in any of the cases referred to in sub-paragraphs (1), (2), and (3) of Article (2) of this Decree will be released upon the payment by its Owner of the following amount: 1. one hundred thousand Dirhams (AED 100,000.00), where the Vehicle is impounded pursuant to sub-paragraph (1) of Article (2) of this Decree; 2. fifty thousand Dirhams (50,000.00), where the Vehicle is a Recreational Motorcycle impounded pursuant to sub-paragraph (2) of Article (2) of this Decree; or 3. ten thousand Dirhams (10,000.00), where the Vehicle is impounded pursuant to sub-paragraph (3), (6), or (7) of Article (2) of this Decree. b. A Vehicle impounded pursuant to sub-paragraph (4) of Article (2) of this Decree will be released upon the payment by its Owner of the fines imposed on him. c. A Vehicle impounded pursuant to sub-paragraph (5) of Article (2) of this Decree will be released upon renewal of the Vehicle’s licence by its Owner. d. A Vehicle impounded by the Police in any of the cases mentioned in the Schedule attached to this Decree will be released subject to the following: 1. lapse of the impoundment period, or payment by the Vehicle's Owner of the amounts stated in paragraph (e) of this Article to release the impounded Vehicle; 2. settlement of all fines payable as per the traffic file; 3. remedy or redress of the violation; and 4. fulfilment of any other conditions determined pursuant to the relevant resolutions issued by the General Commander.

A Vehicle impounded pursuant to the provisions of the above-mentioned Ministerial Resolution No. (127) of 2008 in any case other than those provided for in this Decree will be released upon the payment by the Vehicle Owner of one hundred Dirhams (AED 100.00), if it is a light Vehicle, or two hundred Dirhams (AED 200.00), if it is a heavy Vehicle, per each day of the impoundment period or of the remaining days thereof. f. If the Owner of an impounded Vehicle fails to reclaim it after the lapse of the impoundment period, he must pay fifty Dirhams (AED 50.00) per each day of stay of the Vehicle in the impoundment area after the lapse of that period. Additional Measures

    Article (5) In addition to the penalties and measures prescribed by the legislation in force in the Emirate, where a non-UAE national driver of a heavy Vehicle drives through a red light, he will be administratively deported from the United Arab Emirates. Sale of Impounded Vehicles at Public Auction

    المادة 6

    Article (6) Where the Owner of a Vehicle impounded pursuant to this Decree fails to take the necessary action to reclaim the Vehicle within three (3) months from the date of its impoundment, the Vehicle will be sold at public auction in accordance with the provisions and procedures stipulated in the above-mentioned Law No. (23) of 2015. Grievances

    Article (7) Any affected party may submit to the General Commander a written grievance against any decision, procedure, or measure taken against him in accordance with this Decree or the resolutions issued in pursuance hereof, within fifteen (15) days from the date of being notified of the contested decision, procedure, or measure. The grievance will be determined, within thirty (30) days of its submission, by a committee formed by the General Commander for this purpose, and the decision issued by the committee on the grievance will be final. Payment of Collected Amounts

    Article (8) The amounts collected pursuant to this Decree will be paid to the Public Treasury of the Government of Dubai.

    Article (9) The General Commander will issue the resolutions required for the implementation of this Decree. Repeals

    Article (10) The above-mentioned Executive Council Resolution No. (3) of 2010 is hereby repealed. Any provision in any other legislation will also be repealed to the extent that it contradicts the provisions of this Decree. Publication and Commencement
