Article (1) Article (3) of the Original Decree is hereby superseded by the following:

Article (3) a. DEWA will be exclusively responsible for achieving the following objectives in the Emirate of Dubai: 1. establish; manage; operate; maintain; and own power stations, water desalination plants, water reservoirs, and power transmission and water distribution networks and systems in the Emirate of Dubai; ©2020 The Supreme Legislation Committee in the Emirate of Dubai 1 Every effort has been made to produce an accurate and complete English version of this legislation. However, for the purpose of its interpretation and application, reference must be made to the original Arabic text. In case of conflict, the Arabic text will prevail.

This includes the treatment of water to make it potable; water storage and transportation, and distribution of water to consumers in the Emirate; and 3. implement and manage the projects related to electricity generation and supply of water to meet the needs of the public and the requirements of development in the Emirate of Dubai. b. For the purpose of achieving the objectives mentioned in paragraph (a) of this Article, DEWA may: 1. purchase water and electricity from any entity at the rates and under the terms that DEWA deems appropriate; 2. solely, or in partnership with other persons, establish, manage, and operate power stations and water desalination plants in the Emirate of Dubai; and establish any companies required for this purpose, in accordance with the relevant applicable legislation; 3. purchase, sell, and supply fuel to the entities and companies authorised under the legislation in force in the Emirate of Dubai to produce electricity and water; 4. own, possess, take lease of, and lease out land and other real property as required for the achievement of its objectives; 5. invest its property as it deems appropriate, and borrow funds with or without security; 6. grant usufruct rights and any other real right in respect of the land owned by DEWA to any other entity or company that participates in the production of electricity and water in the Emirate of Dubai; and 7. perform any other work or activities that are directly or indirectly related to the achievement of its objectives.
