Civil divorce for non-Muslim expats in Abu Dhabi — what is the actual timeline?

سأله Anonymous·7 مايو 2026·2 إجابات
My spouse and I are British, married in London, resident in Abu Dhabi 7 years, two children aged 4 and 9. Both consent to divorce. We have heard the new non-Muslim court is faster. Realistically, from filing to decree, how long and what custody framework will the court apply?

Federal Decree-Law 41 of 2022 on Civil Personal Status for Non-Muslims and the Abu Dhabi Civil Family Court (active since 2022) deliver an uncontested divorce in 6-10 weeks on average, with no waiting period or mandatory mediation. The new framework presumes joint custody between equally fit parents and applies post-divorce financial settlement on a needs + contribution basis rather than the Sharia maintenance model. File electronically; both parties only need to attend a single hearing if both consent.

Confirmed. One trap: if either party has assets in the home country, structure the consent decree with explicit reciprocal-enforcement language so it is recognised by an English court without re-litigation. The Abu Dhabi court will sign off on a private settlement agreement on division and custody that you draft beforehand — bring it ready, not as a draft for the judge to write.
